July 23,2008 <br /> PUBLIC HEARING—COUNCIL BILL NO.0807-28 <br /> President Nielsen opened a public hearing regarding Council Bill No. <br /> 0807-28,a proposed ordinance amending Sections 1 and 4 of Ordinance <br /> No.1071-89,as amended(EMC Title 19,Zoning),and establishing a new <br /> Mobile Home Park Overlay Zone. <br /> David Tyler,Planning,stated that this code amendment was originally <br /> initiated by the coundl in response to the closure of mobile home parks <br /> within the city. The amendment establishes a new mobile home perk <br /> zone in which mobile home parks would be the only permitted use.It is <br /> subject to a voluntary request from the mobile home park owner. The <br /> goal of the proposed ordinance is to provide an incentive for owners to <br /> retain existing parks In the foam of potentially tower property taxes or <br /> slowing the increase of property taxes. He remarked that this zoning <br /> amendment only applies to existing mobile home parks In residential <br /> zones not to perks which are in business or commercial zones. <br /> Mr.Tyler distributed a proposed amendment to Section 4 C of the <br /> ordinance which reads,"The zone shall be self-renewing annually for a <br /> five year period unless the owner notifies the park tenants and the City <br /> after the third anniversary of the rezone agreement of his/her intent to'opt <br /> out of the MHP zone'a minimum of two(2)years prior to'expiration of the <br /> remaining effective period of the rezone agreement. <br /> Council Member Olson questioned what the incentive was for the owner <br /> of an existing mobile home park to convert.Dave stated that the five-year <br /> commitment to retain the mobile home park could be conveyed to the <br /> county assessor fora possible reduction in tax value. <br /> Council Member Olson questioned whether there are any guarantees of <br /> lower property taxes.Mr.Tyler stated that there were no guarantees. <br /> Council Member Stonecipher questioned what the cost to the property <br /> conwould be to go through the process and whether the City has <br /> sidered waiving those fees. Dave Tyler commented that the rezone <br /> fees are between$500.00 and$1,000.00 and that there is nothing in the <br /> proposed ordinance that would waive rezone fees. <br /> 232 <br />
