January 5,2011 <br /> Hans Juhl,Attorney,Seattle,spoke on behalf of R.L.Apa.He stated that <br /> the question is whether,by leaving the total blank,there is a possibility <br /> that Shoreline Construction could gain an unfair advantage over the other <br /> bidding contractors. <br /> John Welch,Attorney,Seattle,spoke on behalf of Shoreline Construction. <br /> He stated that 0 is their opinion that Shoreline's failure to add the line <br /> items together does not constitute a material variance. He urged the <br /> council to adopt the recommendation of the city and authorize execution <br /> of the contract to Shoreline Construction. <br /> Moved by Council Member Roberts,seconded by Council Member <br /> Hatloe to declare that the failure to include a total in the Shoreline <br /> Construction, Inc. bid is animmaterial irregularity,waive the <br /> immaterial irregularity as informality in the bidding,deny the <br /> protest,and award the construction contract for the Sewer System <br /> Replacement"L"North Area project to Shoreline Construction,Inc., <br /> in the amount of$3,224,841.20 <br /> Roll was called with all council members voting yes. <br /> Motion carried. <br /> AGREEMENT AMENDED—REPLACEMENT OF WATER <br /> TRANSMISSION LINES 2 AND 3 PHASE 6 <br /> Moved by Council Member Stonecipher,seconded by Council <br /> Member Nielsen to authorize the Mayor to sign Supplemental <br /> Agreement No.6 with MWH Americas,Inc.for replacement of Water <br /> Transmission Lines 2 and 3-Phase 6 project. <br /> Roll was called with all council members voting yes. <br /> Motion carried. <br />
