The city recognizes that each person has a fundamental and inalienable right to a healthful environment <br /> and that each person has a responsibility to contribute to the preservation and enhancement of the <br /> environment. <br /> 19.43.260 Notice—Statute of limitations. <br /> A. The city,applicant for,or proponent of an action may publish a notice of action under RCW 43.21C.080 for any <br /> action. <br /> B. The form of the notice shall be substantially in the form provided in WAC 197-11-990.The notice shall be <br /> published by the city clerk or proponent pursuant to RCW 43.21C.080. Use of a notice of action shall not be <br /> construed to reopen an appeal period if a party previously failed to exhaust its administrative remedies. <br /> 19.43.320 Third party liability. <br /> A. This chapter provides for and promotes the health,safety and welfare of the general public,and does not <br /> create or designate any particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this chapter. <br /> B. Nothing contained in this chapter is intended to be nor shall be construed to create or form the basis for any <br /> liability on the part of the city,its officers,employees or agents,for any injury or damage resulting from the <br /> failure of any applicant to comply with the provisions of this chapter,or by reason or in consequence of any <br /> inspection,notice,order,certificate,permission or approval authorized or issued or completed in connection <br /> with the implementation or enforcement pursuant to this chapter or by reason of any action or inaction on <br /> the part of the city related in any manner to the enforcement of this chapter by its officers,employees or <br /> agents. <br /> Ch.19.43,Environmental Policy 8 City Council Action(11/04/2020) <br />
