C fa EVE WASHINGTON 1 CITY OF EVERETT,WASHINGTON CONTRACT THIS CONTRACT is made and entered into this / z day of 00,)eMbe( 2020, by and between the City of Everett, Washington, a municipal corporation existing under the laws of the State of Washington, hereinafter called the "City", and R.L. ALIA Company, a Corporation hereinafter called the "Contractor." In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish all labor,tools, materials, equipment, and supplies required to build and construct in a workmanlike manner the work, improvements, and appurtenances in accordance with the Specifications and Plans entitled: SIDEWALK IMPROVEMENTS—16TH STREET&CHESTNUT STREET, EVERETT WA The following documents ("Contract Documents") are incorporated by reference and are hereby made a part of this Contract: A. Invitation for Quote B. Information for Contractors C. Modified Standard Specifications and Contract Drawings D. COVID-19 Site Safety Plan E. Change Orders (if any) F. Addenda (if any) G. Quote Proposal submitted by the Contractor as to those items and/or alternatives accepted by the City(Conformed copy dated October 20, 2020.) H. Payment and Performance Bond I. All provisions required by law whether here inserted or not J. Project Construction Plans K. City Standard Drawings L. All provisions required by law whether set forth and reproduced herein or not The work shall be physically complete in all respects within twenty-five (25) working days from the date of issuance of the Notice to Proceed. The parties agree the City will suffer damage and be put to additional expense in the event that the Contractor does not complete the work in all respects and have it ready for use by the physical completion date stated. The amount of this contract is One Hundred Thirty-Six Thousand Dollars Even ($136,000.00) and is based on the quote submitted by the Contractor dated October 20, 2020 The basis for final payment will be the actual amount of work performed according to the Contract Documents and payments, whether partial or final, shall be made as specified therein. If, and to the extent, payment (in whole or in part) is based upon unit prices multiplied by quantities of work actually performed,the total amount paid to the Contractor may be less than Contract amount stated herein and the Contractor agrees to execute one or more change orders in such event. In no event shall the total amount paid Contractor exceed the Contract amount stated herein, unless the Contract amount has first been increased by one or more Change Orders signed by the City.
