Imo <br /> Exhibit J `! <br /> 2019 CDBG Subrecipient Agreement EVE R E T T <br /> WASHINGTON <br /> Federal Labor Standards Roles and Responsibilities Agreement <br /> This agreement establishes procedures by which Dawson Place (hereinafter "Subrecipient") and City of Everett <br /> (hereinafter"CoE")coordinates and monitors the construction work at Dawson Place Administrative Offices located <br /> at1509 California Street, Everett, WA 98208 (hereinafter "Project"). COE will award the construction work as <br /> prescribed by HUD Handbook 7460.8 to a contractor and monitor its compliance with Federal labor standards. <br /> SCOPE <br /> This project will be implemented by the subrecipient with Community Development Block Grant funds provided by <br /> the COE. This AGREEMENT relates solely to the construction work listed within the scope at the Project funded by <br /> the COE. For purposes of this AGREEMENT only, construction includes all Project construction activity when the <br /> Project is funded in whole or in part with COE's CDBG funds requiring Davis-Bacon Act compliance. <br /> PURPOSE <br /> The purpose of this AGREEMENT is to foster cooperation and coordination between COE and the Subrecipient to <br /> maximize local governmental efficiency. This AGREEMENT is intended to establish a clear understanding of the <br /> procedures of one agency so that the other may choose whether to duplicate them. This AGREEMENT is not a legally <br /> binding commitment, nor will it serve as any legal remedy for either party or for any third person. <br /> CDBG FUNDING <br /> The COE is a recipient of Community Development Block Grant Program ("CDBG") funds under the Housing and <br /> Community Development Act of 1974 ("HCD Act"), Public Law 93-383 as amended. COE has allocated $76,355 in <br /> CDBG funds for the Project and specified that all or a portion of these funds will be used by the Owner for <br /> construction work. <br /> MONITORING <br /> A. Labor Standards. <br /> Davis-Bacon Related Act: Title I, of the HCD Act and regulations at 24 CFR Part 570.603 require laborers and <br /> mechanics employed by contractors or subcontractors that perform construction work financed in whole or in part <br /> with CDBG funds must be paid at rates no lower than those determined in accordance with the Davis-Bacon Act,as <br /> amended (40 U.S.C.sections 276(a)-276(a)(5)). <br /> Contract Work Hours & Safety Standards Act (CWHSSA): The HCD Act further requires that contractors and <br /> subcontractors comply with overtime compensation requirements and pay covered workers no less than one- and <br /> one-half times the base rate for hours exceeding 40 in a 7-day week in accordance with CWHSSA. <br /> Copeland Act:The Act makes it a Federal crime to cause or incur'kickbacks'(i.e.,give up or pay back)of any part of <br /> a laborer or mechanics wages. <br /> For purposes of this AGREEMENT,"labor standards"shall include these statutes and their implementing regulations <br /> 29 CFR Part 1,3,5,6,7. It is understood that the parties may enforce additional requirements, not inconsistent with <br /> those Acts and regulations, related to labor and contracting for the Project. <br /> Where it is determined that CDBG funds trigger the application of these labor standards requirements,the COE will <br /> ensure that the labor standards provisions(HUD 4010)and the applicable wage determination are incorporated into <br /> the prime contract. <br /> 1 <br />
