The COE will monitor labor standards compliance for construction work on the Project according to the procedures <br /> outlined on Exhibit A to this AGREEMENT. <br /> B. Section 3. <br /> If page 1 of this AGREEMENT indicates that the parties have determined that contracting conditions apply to the <br /> construction work pursuant to HUD regulations under 12 U.S.C. 1701u (section 3 of the Housing and Urban <br /> Development Act of 1968),then(A)the COE will review the bid specifications and the general or prime contract for <br /> construction to see that it includes the language required by 24 CFR Part 135 and the additional provisions prescribed <br /> by HUD for Section 3 implementation, as listed on Exhibit B to this AGREEMENT, substantially in the form most <br /> recently provided by CoE;and (B)the COE will monitor the Project for compliance with these provisions according <br /> to the procedures outlined on Exhibit B to this AGREEMENT. <br /> The COE will not request reimbursement for any costs or expenses related to the monitoring on this Project. <br /> REPORTING,NOTICES,RECORDS,TERM <br /> Notices. <br /> City of Everett Subrecipient <br /> Kembra Landry Lori Vanderburg <br /> City of Everett Department of Community,Planning,and Economic Dawson Place <br /> Development <br /> 2930 Wetmore Avenue,Suite 8A 1509 California Street <br /> Everett,WA 98201 Everett,WA 98201 <br /> Voice: (425)257-7155 Voice: 425-789-3062 <br /> e-mail: klandry@everettwa.gov e-mail: lori.vanderburg@dawsonplace.org <br /> Records. The Subrecipient will make all records related to the Project's labor standards and Section 3 compliance <br /> available to COE upon request,subject to any applicable privacy or confidentiality laws. The Subrecipient will retain <br /> such records as required by HUD regulations. <br /> Inquiries and Responses. The COE may contact the Subrecipient's officer named above at any time during the <br /> Project. Promptly upon such request,the Subrecipient shall inform the COE of any known violations or discrepancies <br /> of labor standards or Section 3 compliance detected. Neither the Subrecipient nor any of its employees or agents <br /> may be held liable to the COE or to any third party for this agreement. Should there be any defects, inaccuracies, <br /> misrepresentations by contractors/subcontractors, or other issues with enforcement under this AGREEMENT, the <br /> Subrecipient and its staff will be held harmless for the efforts at minimizing the administrative costs. <br /> Termination. This AGREEMENT may be terminated at any time upon written notification of either party and with five <br /> working days'advance notice. <br /> Time Period. The time period of this AGREEMENT shall be from the time the COE approves the Subrecipient's bid <br /> specifications until the project is complete and all compliance issues resolved, unless earlier terminated as stated <br /> above. <br /> 2 <br />
