AMENDMENT NO. 1 <br /> TO <br /> SECONDARY SERVICE CONTRACT <br /> This AMENDMENT NO. 1 TO SECONDARY SERVICE CONTRACT (this <br /> "Amendment") is dated for reference purposes the 31 st day of December, 2020, and is by and <br /> between the City of Everett, a Washington municipal corporation("Everett"), and Public Utility <br /> District No. 1 of Snohomish County, a Washington municipal corporation("PUD"). <br /> RECITALS <br /> A. Everett and PUD are parties to a Secondary Service Contract dated February 7, 2011 (the <br /> "Contract"). <br /> B. Everett and PUD desire to amend the Contract to extend certain implementation <br /> deadline(s). <br /> AGREEMENT <br /> Everett and PUD agree as follows: <br /> 1. Amendment to Section 5.7. The fourth sentence of Contract Section 5.7 is <br /> hereby amended as follows, with underlined text added and strike-out text deleted: <br /> Reduced starting capabilities or soft starts shall be implemented on pump motors No. 1 <br /> & 2 (located in positions 1 &2 sequentially at the plant from East to West)when <br /> upgraded, or after 4-0 12 years from the implementation of this contract. <br /> 2. Full Force and Effect. All provisions of the Contract remain in full force and <br /> effect, except as expressly modified by this Amendment. <br /> [Signature page follows] <br /> 1 <br />
