1. RCW 82.14.460; <br /> 2. Snohomish County Ordinance Number 20-075; and <br /> 3. Snohomish County Human Services Department Management and Policy <br /> Memoranda, as applicable. <br /> II. ORDER OF PRECEDENCE <br /> In the event that any provisions of the Contract, including all authorities <br /> incorporated by reference, are in conflict with one another, the provision which is <br /> the more encompassing and restrictive on the City's actions shall apply. In the <br /> event that equally restrictive provisions are in conflict with one another, the sources <br /> of the provisions shall govern their precedence. The order of precedence shall be <br /> first federal, then state, then local, and shall in all cases be ruled upon by the <br /> County. <br /> III. SCOPE OF SERVICES <br /> A. The City shall provide the services described in the Approved or amended <br /> Approved Exhibit B (Statement of Work), pursuant to the provisions of this <br /> Contract. <br /> B. The City shall initiate criminal history background checks pursuant to RCW <br /> 43.43.830 and RCW 43.43.834 for all prospective employees and volunteers <br /> who may have unsupervised access to children under sixteen years of age, <br /> developmentally disabled persons of any age, or vulnerable adults. <br /> IV. FINANCIAL AWARD <br /> A. The City is hereby awarded, in the form of a subaward, the total sum indicated <br /> in Exhibit C, Approved Contract Budget, to provide part of the funding for the <br /> full undertaking and performance of the Project. It is expressly agreed and <br /> understood that the total amount paid by the County under this Agreement shall <br /> not exceed the total subaward indicated in Exhibit C. <br /> B. In the event funding from state, federal, or other sources is withdrawn, reduced, <br /> or limited in any way after the effective date of this Contract and prior to normal <br /> completion, the County may amend the Contract amount to reflect any new <br /> funding limitations and conditions. <br /> C. Allowable costs under this Contract shall include costs incurred by the City <br /> during the Contract term set forth on the Contract Face Sheet, PROVIDED, that <br /> all costs shall not exceed the Contract Maximum, and PROVIDED, FURTHER, <br /> that no payments will be made before the Effective Date. <br /> Exhibit A <br /> HCS-21-29-2101-198 <br /> City of Everett <br /> Page 2 of 13 <br />
