STANDARD PROCUREMENT POLICY& FEDERAL EMERGENCY CONTRACTING <br /> • Self-benefit. Using your position or relationship within the City to promote your own <br /> interests or those of your immediate family, including use of confidential or privileged <br /> information acquired in the course of employment at the City for benefit or gain of yourself <br /> or a member of your immediate family. <br /> • Influence peddling. Soliciting benefits for yourself or an immediate family member from <br /> outside organizations in exchange for using your influence to advance the interests of that <br /> organization with the City. <br /> • Other business relationships and dealings. Approving contracts with organizations in which <br /> you or a member of your immediate family have a financial or other interest or relationship, <br /> particularly if you are in a position to influence major decisions, are responsible for review, <br /> negotiation and approval of the contracts, or otherwise direct the City's business dealings <br /> with that business or entity. <br /> • Outside commitments. Subject to applicable law, participating in social or political activities <br /> is not restricted as long as you participate as an individual and not as a representative of the <br /> City. <br /> • Property transactions. Directly or indirectly leasing, renting, trading, or selling real or <br /> personal property to or from the City. <br /> • Use of the City's property for personal advantage. Using or taking City resources, including <br /> facilities, equipment, personnel, and supplies, for private use or other unauthorized non- <br /> City activities. <br /> • Recording or reporting false information. Misrepresenting, withholding, or falsifying <br /> relevant information required to be reported to external parties or used internally for <br /> decision-making purposes, in order to derive personal benefit. <br /> • Dealings with suppliers or contractors. Personally, accepting anything of value from <br /> organizations or individuals that have or will have proposals pending with the City, or <br /> otherwise do business with the City in exchange for actual or the appearance of favorable <br /> influence. <br /> 3.5 MANAGEMENT OF REAL OR POTENTIAL CONFLICTS OF INTEREST <br /> Upon disclosure,the impacted person must refrain from participating in the selection, award or <br /> administration of the affected contract until a determination has been made by the City as to <br /> whether the employee has a prohibited conflict of interest. The employee involved in the <br /> conflict situation will work with the employee's immediate supervisor, the City Attorney's office, <br /> and the Conflict of Interest Compliance Officer or designee to resolve the conflict issue in the <br /> best interests of the City. If the City determines that an employee has a real or apparent conflict <br /> of interest, the City will disqualify the employee from acting on any matter or participating in <br /> any decision(s) that could be impacted by the conflict. <br /> Any employee that does not comply with the conflict of interest sections outlined herein may be <br /> subject to disciplinary action, up to and including termination, if warranted by the offense. If an <br /> employee fails to comply with the requirements applicable to conflicts of interest,the selection <br /> and award of the impacted contract is not automatically invalidated, although it may be.
