STANDARD PROCUREMENT POLICY& FEDERAL EMERGENCY CONTRACTING <br /> 3.7 STANDARDS OF ETHICAL CONDUCT <br /> Public employment is a public trust. City officials and employees must discharge their duties <br /> impartially to ensure that responsible suppliers have fair competitive access to City procurement <br /> processes. Moreover, they shall conduct themselves in such a manner as to foster public <br /> confidence in the integrity of the City's procurement process. <br /> City officials and employees shall have no interest,financial or otherwise, direct or indirect, nor <br /> engage in any business transactions or activities, nor incur any obligation of any nature, which is <br /> in conflict with the City of Everett or state or federal law. <br /> City officials and employees are expected to comply fully with all applicable ethical laws and to <br /> demonstrate the highest standards of personal integrity and to conduct their duties in ways that <br /> are free from the inference or perception that favorable treatment was sought, received or <br /> given, and to avoid any interest or activity which is in conflict with the conduct of official duties. <br /> City awarded contracts are for City business only and cannot be used for personal use. <br /> 3.8 LOBBYING LIMITATIONS <br /> After the issuance of any solicitation and prior to contract award or during any amendments to <br /> existing contracts, no prospective supplier, or its agents, representatives or persons acting at the <br /> request of the suppliers may contact, communicate with, or discuss any matter relating to the <br /> solicitation or amendment with any City employees other than the Procurement Professional or <br /> designated City employee responsible for the solicitation. This prohibition includes copying such <br /> persons on written communication with the Procurement Professional but does not apply to <br /> presentations made to the evaluation committee or at any public meeting where the proposed <br /> contract is being considered for award. <br /> 3.9 PROTEST <br /> Suppliers may appeal or protest an invitation, solicitation, or award of contract issued by the <br /> City by following the requirements of Chapter 3.46, Everett Municipal Code. <br /> 3.10 SUSPENSION AND DEBARMENT <br /> The City will not award, subaward, or contract with any supplier that is debarred, suspended, or <br /> otherwise excluded from or ineligible for participation in Federal assistance programs or <br /> activities. [2 C.F.R. § 200.213] The Procurement Division is responsible for verifying non- <br /> debarment status for purchases made with a purchase order. Motor Vehicle Division Buyers are <br /> responsible for verifying non-debarment status for purchase orders issued by their division. <br /> Departments are responsible for verifying non-debarment status for any purchase that is made <br /> without the issuance of a purchase order. This includes PCard purchases. See the Excluded <br /> Parties Procedure. <br /> Page 16 of 57 <br />
