STANDARD PROCUREMENT POLICY & FEDERAL EMERGENCY CONTRACTING <br /> 5.10 COST PLUS A PERCENTAGE OF COST <br /> In projects subject to federal requirements, the City will follow 2 C.F.R. § 200.323, which is an <br /> express prohibition on the use of cost plus a percentage of cost (CPPC) and cost plus a <br /> percentage of construction cost methods of contracting. <br /> 5.11 DISCLOSURE OF CONFLICTS OF INTEREST <br /> The City will disclose, in writing, any real or potential conflict of interest impacting the <br /> procurement of a Federal contract to the associated federal awarding agency or pass-through <br /> entity within 14 days of learning of same. <br /> 5.12 FEDERAL EXCESS AND SURPLUS PROPERTY <br /> The City will follow 2 C.F.R. § 200.318(f),which currently states,the non-Federal entity is <br /> encouraged to use Federal excess and surplus property in lieu of purchasing new equipment and <br /> property whenever such use is feasible and reduces project costs. <br /> 5.13 GEOGRAPHICAL PREFERENCES IN FEDERAL CONTRACTS <br /> The City will conduct procurements of Federal contracts in a manner that prohibits the use of <br /> statutorily or administratively imposed state, local, or tribal geographical preferences in the <br /> evaluation of bids or proposals, except in those cases where applicable federal statutes <br /> expressly mandate or encourage geographic preference. <br /> When contracting for federally funded architectural and engineering (A&E) services, the City <br /> may use geographic location as a selection criterion provided its application leaves an <br /> appropriate number of qualified firms, given the nature and size of the project, to compete for <br /> the contract. Examples of prohibited geographical preferences include: <br /> • Excluding suppliers or contractors from outside a geographic area. <br /> • Providing a local supplier that has submitted a bid within a certain percentage of the lowest <br /> bid to match the lowest bid. <br /> • Reducing, by a percentage, a bid submitted by a local supplier during the evaluation of bids <br /> submitted during sealed bidding. <br /> • Adding weight on evaluation factors to an in-state or local business as part of a procurement <br /> by competitive proposals. <br /> 5.14 INDEPENDENT COST ESTIMATES <br /> The City will develop an independent estimate for all contract work that is anticipated to exceed <br /> the Micro-Purchase threshold as identified by the Office of Management and Budget OMB <br /> Memo M-18-18, currently$10,000. The purpose of the independent cost estimate is to provide <br /> a tool to determine if pricing is reasonable and is valuable to help determine whether suppliers <br /> have understood the scope of work as outlined.
