STANDARD PROCUREMENT POLICY& FEDERAL EMERGENCY CONTRACTING <br /> SECTION 9 - COMPETITIVE BIDDING - EXEMPTIONS AND EXCLUSIONS <br /> Competitive bidding requirement exemptions are governed by RCW 39.04.280. The following <br /> commodities are excluded from the competitive requirements provided in this policy. <br /> 9.1 EXEMPTIONS LIST <br /> • Advertising to promote the City or other advertising business needs <br /> • Any exchange wherein the City of Everett receives services or property in exchange for <br /> consideration other than money <br /> • Contracts for employment whether negotiated through duly authorized labor representative <br /> or not, and payroll disbursements or any other payments incidental to such contracts <br /> • Employee benefit services procured through brokers <br /> • Employee allowance purchased items such as boots and prescriptive eye protection for Fire <br /> that are bought by the employee with a city provided allowance. <br /> • Environmental analytical testing coordinated through the Everett Utility Operations that <br /> include Environmental Laboratory, Environmental Monitoring and Compliance group, or <br /> Water Filtration Water Quality employees. Examples include wastewater, drinking water, <br /> stormwater, surface water, biosolids, and waste disposal. <br /> • Fuel hedging contracts <br /> • Grants and gifts or such purchases made with the proceeds from any grant, gift, bequest or <br /> donation to the extent the application of this policy would conflict with the requirements, <br /> conditions, or limitations attached to the grant,gift, bequest, or donation <br /> • Insurance and bond purchases <br /> • Interdepartmental transactions <br /> • Services of law firms or outside counsel, expert witnesses, trial consultants, adjusters or <br /> other persons or firms deemed by the City Attorney as necessary to address the City's legal <br /> needs. Such firms or persons must be selected by the City Attorney or his or her designee <br /> and the form of contract or engagement will be as approved by the City Attorney or his or <br /> her designee. <br /> • Memberships and dues <br /> • Performers who are hired to entertain for City-sponsored community events <br /> • Postage, permit fee, license involving a single source of governmental entity <br /> • Professional development services for employees as determined by Human Resources <br /> • Public utility service such as water, sewer, electricity, phone and others as classified <br /> Page 40 of 57 <br />
