1 <br /> Port of <br /> EVERETT <br /> March 23, 2021 <br /> City of Everett <br /> 802 E Mukilteo Blvd. <br /> Everett, WA 98203 <br /> Attn: Bob Leonard <br /> RE: Interlocal Agreement between the Port of Everett and the City of Everett regarding the <br /> Cooperative Use of Facilities, Equipment,and Resources,executed June 18, 2003 <br /> To the City of Everett: <br /> The City of Everett,a municipal corporation (the"City") and the Port of Everett,a municipal corporation <br /> (the "Port")entered into that certain Interlocal Agreement Between the Port of Everett and the City of <br /> Everett Regarding the Cooperative Use of Facilities, Equipment,and Resources,executed June 18, 2003 <br /> (the"Interlocal").The City and the Port agree to this Letter of Understanding(this "Letter"),to clarify <br /> some of the terms and conditions of the Interlocal as related specifically to Port use of City owned <br /> planters. The Port proposes the following terms and conditions: <br /> 1. This Letter only applies to the planters currently in the City's possession (the <br /> "Planters"),and are therefore not applicable to the soil, the flowers,or any other <br /> plants, as they relate to the Planters. <br /> 2. The Port will inspect all Planters upon receipt from the City and document any already <br /> existing defects or damage to the Planters prior to the Port's possession and use of the <br /> Planters. <br /> 3. The Port,or a party contracted by the Port,shall be responsible for the initial <br /> transportation of the Planters from their current location to the Port's property along <br /> the waterfront. <br /> 4. Upon the expiration of the Port's use of the Planters,the Port, or a party contracted by <br /> the Port,shall be responsible for removing the Planters from the Port's property and to <br /> return the Planters to the City's desired location. <br /> 5. If any of the Planters are broken while in the Port's possession,on the Port's property, <br /> or while in transit under the Port's control,the Port will reimburse the City for the value <br /> of the Planter at the time it was broken. <br />
