CITY OF EVERETT SPECIAL PROVISIONS <br /> Each working day shall be charged to the Contract as it occurs, beginning on the effective <br /> date of the Notice to Proceed, unless otherwise provided in the Contract Documents, until <br /> the Contract Work is physically complete. Each week the Engineer will provide the <br /> Contractor a statement that shows the number of working days: (1) charged to the Contract <br /> the week before; (2) specified for the physical completion of the Contract; and (3) remaining <br /> for the physical completion of the Contract. The statement will also show the nonworking <br /> days and partial or whole day the Engineer declares as unworkable. Within 14 calendar <br /> days after the date of each statement, the Contractor shall file a written protest of any alleged <br /> discrepancies in it. To be considered by the Engineer, the protest shall be in sufficient detail <br /> to enable the Engineer to ascertain the basis and amount of time disputed. By not filing such <br /> detailed protest in that period, the Contractor shall be deemed as having accepted the <br /> statement as correct. If the Contractor elects to work ten hours a day and four days a week <br /> (a 4-10 schedule)and the fifth day of the week in which a 4-10 shift is worked would ordinarily I <br /> be charged as a working day then the fifth day of that week will be charged as a working day <br /> whether or not the Contractor works on that day. <br /> The Engineer will give the Contractor written notice of the Physical Completion Date for all <br /> Work the Contract requires. That date shall constitute the Physical Completion Date of the <br /> Contract but shall not imply the City's acceptance of the Work or the Contract. <br /> The Engineer will give the Contractor written notice of the Completion Date of the Contract <br /> after all the Contractor's obligations under the Contract have been performed by the <br /> Contractor. The following events must occur before the Completion Date can be established: <br /> 1. The physical Work on the project must be complete; and <br /> 2. The Contractor shall furnish all documentation required by the Contract and <br /> required by law, to allow the City to process final acceptance of the Contract. <br /> The following documents must be received by the Engineer prior to establishing a Completion <br /> Date: <br /> a. Certified payrolls. <br /> b. Material Acceptance Certification Documents. ' <br /> c. Annual Report of Amounts Paid as MBE/WBE Participants. <br /> d. Final Contractor Voucher Certification. <br /> e. Copies of the approved "Affidavit of Prevailing Wages Paid" for the Contractor and all <br /> Subcontractors. <br /> Supplement 1-08.5 by adding the following: <br /> 1-08.5(2) Substantial Completion <br /> (******) <br /> When the Contractor considers the Work to be Substantially Complete and ready for its intended <br /> use, it shall give Notice to the City's Representative. The Notice shall include an itemized list of <br /> remaining incomplete Work. If the City's Representative determines the Work is not substantially <br /> complete, it will so notify the Contractor in writing, identifying the reasons for such a <br /> determination. If the City's Representative finds the Work substantially complete, it will meet <br /> with the Contractor to (1)prepare a Punch List of incomplete items of Work; (2)define the division <br /> of responsibility between City and Contractor with respect to security, operation, maintenance, <br /> heat, utilities, insurance, and warranties; and (3) describe other issues related to acceptance of <br /> the substantially completed Work. 111 <br /> If the City's Representative is not an employee of the City, the City's Representative will write to <br /> the City upon reaching agreement with the Contractor, certifying that the Work is substantially <br /> complete, listing the items of incomplete Work, stating the date for completion of incomplete work, <br /> defining the division of responsibilities, and setting forth any other terms related to acceptance. <br /> SEI to SRI Intertie,SRO8 Rehab Division 1 -GENERAL REQUIREMENTS WO No.-UP3714 <br /> SP-96 <br /> 1 <br />
