I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> ' Additive: A supplemental unit of work or group of bid items, identified separately in the Proposal, <br /> that may, at the discretion of the City, be awarded in addition to the base Bid. <br /> Alternative or Alternate: One of two or more units of Work or groups of bid items, identified <br /> separately in the Proposal, from which the City may make a choice between different methods or <br /> material of construction for performing the same Work. <br /> ' Award Date: The date of the formal action by the Everett City Council to accept the lowest <br /> responsible and responsive Bidder for the Work. <br /> Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> Business Day: A business day is any day from Monday through Friday except holidays as listed <br /> in 1-08.5. <br /> Change Order: Reference to Change Order shall include all rights of the City and Contractor <br /> ' under 1-04.4 CHANGES. Agreed Change Orders shall be in the form attached as Appendix C. <br /> Unilateral Change Orders shall be in the form attached as Appendix C. <br /> Contract Claim: Any request by the Contractor for additional time or money resulting in <br /> ' adjustment of Contract Sum or Contract Time irrespective of the cause or reason for the request. <br /> Contract Claims include, but are not limited to, requests by the Contractor for additional time or <br /> money due to Extra Work, inefficiencies, Delays, interferences, and problems with the design. <br /> Contract Claim includes, but is not limited to, claims or requests by Subcontractors for extensions <br /> of Contract Time, adjustment of Contract Sum, additional compensation that the Contractor <br /> attempts to pass through or assert against the City, or claims against the City arising out of a third <br /> ' party's claim against the Contractor. <br /> Contract Documents: See definition for"Contract." <br /> Contract Execution Date: The date the Mayor of the City of Everett signs the Contract or the <br /> ' date that the Contractor signs the Contract, whichever date is later. This officially binds the <br /> Contractor to the Contract. <br /> Contract Sum: The price in dollars stated in the Contract to be paid by the City to the Contractor <br /> for the Work described in the Contract Documents, as modified by Change Orders. <br /> ' Contract Time: The period of time established by the terms and conditions of the Contract within <br /> which the Work must be physically completed. <br /> Delay: Any increase in the duration of the critical path of the Project. <br /> Dispute: Any controversy or disagreement. <br /> Equipment: Mechanical, electrical, instrumentation, or other devices with one or more moving <br /> ' parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic connection. <br /> Extended Overhead: The increase in Overhead costs attributable to an extension of Contract <br /> Time. <br /> ' Extra Work: Providing materials and Equipment and the performance of Work not directly called <br /> for in, or implied by, the Contract Documents, such that Contractor would be entitled to an <br /> adjustment of Contract Sum and possibly an extension of Contract Time. <br /> Final Acceptance: Formal action by Everett City Council determining that all of the Contractor's <br /> Work has been completed, except for any landscaping maintenance. <br /> Float: The amount of time between the early start date and the late start date, or the early finish <br /> ' date and the late finish date of an activity in the Project schedule. <br /> Force Account: Costs of performing Work as defined in 1-09.6 FORCE ACCOUNT. <br /> Furnish: To deliver items, Equipment, or material to the job site or other specified location. <br /> ' Install: Placing, erecting, or constructing complete in place items, Equipment, or material. <br /> May: Conduct that is permitted, but not required. <br /> ' SEI to SRI Intertie,SRO8 Rehab Division 1 -GENERAL REQUIREMENTS WO No.-UP3714 <br /> SP-41 <br />
