I <br /> ICITY OF EVERETT SPECIAL PROVISIONS <br /> Any prospective Bidder desiring an explanation or interpretation of the Bid Documents, shall <br /> request the explanation or interpretation in writing by close of business three business days <br /> I <br /> preceding the bid opening to allow a written reply to reach all prospective Bidders before the <br /> submission of their Bids. <br /> Supplement 1-02.4(1) by adding the following: <br /> I <br /> Bidder acknowledges that he/she has not relied on representation or warranty of the City not <br /> expressly included in the Contract Documents. <br /> The information provided by the City is not intended to be a substitute for, or a supplement <br /> I <br /> to, the independent verification by the Bidder to the extent such independent investigation of <br /> the Drawings and Specifications or Site conditions is deemed necessary or desirable by the <br /> Bidder. Bidder acknowledges that they have not relied upon City or Engineer furnished <br /> Iinformation regarding site conditions in preparing and submitting a Bid. <br /> Further supplement 1-02.4(1) by adding the following: <br /> I1-02.4(1)A Interpretation of Contract Documents <br /> (******) <br /> Should a Bidder find what is believed to be discrepancies in or omissions from the Plans, <br /> I <br /> Specifications, or Special Provisions, or should the Bidder be in doubt as to their meaning, <br /> Bidder may submit to the Engineer a written request for an interpretation thereof. The Bidder <br /> submitting the request will be responsible for its prompt delivery. Any interpretation of the <br /> I documents, if made, will be made only by addendum duly issued and a copy of such <br /> addendum will be mailed or delivered to each Bidder receiving a set of such documents. All <br /> requests for interpretations must be received by the City or Engineer no later than 7 <br /> I calendar days prior to the Proposal opening date. All questions regarding the Contract <br /> Documents shall be referred to the City or Engineer at the address provided in the Contract <br /> Documents. <br /> I <br /> 1-02.4(1)B Prevailing Wages <br /> (******) <br /> Bidder is directed to 1-07.9(1) of these Special Provisions for requirements regarding <br /> applying payment of prevailing wage rates for employment of labor on within Snohomish <br /> ICounty. <br /> 1-02.4(2) Subsurface Information <br /> I Delete the first paragraph and substitute the following: <br /> If the City has made subsurface investigation of the site of the proposed Work, the boring <br /> log data and soil sample test data accumulated by the City will be made available for <br /> inspection by the Bidders. The boring logs and soil sample test data shall NOT be considered <br /> Ias part of the Contract. In addition, the City makes no representation or warranty expressed <br /> or implied that: <br /> 1. The Bidders' interpretations from the boring logs are correct, <br /> 2. Moisture conditions and indicated water tables will not vary from those found at <br /> the time the borings were made, and <br /> 3.
