CITY OF EVERETT SPECIAL PROVISIONS <br /> 7-17.2 Materials-Catalog Cuts or Standard Plans ' <br /> DIVISION 8 MISCELLANEOUS CONSTRUCTION <br /> 8-01 Erosion Control I <br /> 8-01.3(1)Temporary Erosion and Sediment Control (TESC) Plan <br /> 8-31 Lining <br /> 8-31.3(1)B Material/ Shop Drawing Submittals <br /> 8-31.3(1)C Installation Plan <br /> 8-31.3(1)D Grouting Plan <br /> Deviations from Standard Plans will be subject to a Working Drawing submitted by the Contractor <br /> and approved by the Engineer. Where a Working Drawing is required by the Specifications, <br /> related Work performed prior to completion of the Engineer's review of the pertinent submission <br /> will be the sole expense and responsibility of the Contractor. <br /> Supplement 1-05.3 by adding the following: <br /> 1-05.3(1) Submittals <br /> (******) <br /> Where required by the Contract Documents, the Contractor shall submit information, such as <br /> Working Drawings that will enable the City's Representative to advise the City whether the <br /> Contractor's proposed materials, Equipment or methods of work are in general conformance to <br /> the design concept and in compliance with the Plans and Specifications. Approval or acceptance <br /> of a Submittal does not relieve Contractor from complying with Contract requirements. The City's <br /> approval of a Submittal does not constitute a waiver of the Contract requirements. The City will <br /> not be obligated to accept or pay for Work performed by the Contractor that may be affected by <br /> materials, Equipment, or methods of work not submitted in a timely manner so that final review <br /> can be accomplished before the affected Work is complete. The City shall not be responsible for <br /> Delays, inefficiencies, or any additional costs or expenses caused in whole or in part by <br /> Contractor's failure to submit required information in sufficient time for review, comment, and <br /> correction. Contractor's failure to submit required information in sufficient time for review, <br /> comment and correction shall be deemed a waiver of any and all Contract Claims for adjustment <br /> of Contract Sum or Contract Time arising out of, or related to, such a Submittal. Contractor <br /> acknowledges and agrees that it may not rely upon receiving the City's response to a Submittal <br /> in less than 14 calendar days, unless the City explicitly changes this section by a signed Change <br /> Order. <br /> 1-05.3(2) Requests for Information <br /> (******) <br /> Requests for information or clarification from the Contractor to the City shall be treated as a <br /> Submittal pursuant to 1-05.3(1) SUBMITTALS. <br /> 1-05.4 Conformity With and Deviations From Plans and Stakes <br /> Delete all of 1-05.4 and substitute the following: <br /> The Contractor shall be responsible for setting and maintaining all alignment stakes, slope stakes, <br /> and grades necessary for the construction of the roadbed, surfacing, paving, channelization, <br /> illumination, signing, bridges, and retaining walls, if such construction is included in this Project. <br /> Except for the survey control data to be furnished by the City, calculations, surveying, and <br /> measuring required for setting and maintaining the necessary lines and grades shall be the <br /> Contractor's responsibility. The Contractor shall provide the City with copies of such calculations <br /> and staking data when requested by the Engineer.
