CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-05.18(3) Responsibilities <br /> 1-05.18(3)A Manufacturers and Suppliers <br /> ' The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br /> manufacturers, Suppliers and their employees. <br /> 1-05.18(3)B Contractor's Employees <br /> ' The Contractor shall be responsible for the adequacy, efficiency and sufficiency of its <br /> employees. Workers shall have sufficient knowledge, skill and experience to perform <br /> properly the Work assigned to them. <br /> ' 1-05.18(3)C Payment for Labor and Materials <br /> The Contractor shall pay and require its Subcontractors to pay any and all accounts for labor <br /> including Worker's Compensation premiums, State Unemployment and Federal Social <br /> ' Security payments and other wage and salary deductions required by law. The Contractor <br /> also shall pay and cause its Subcontractors to pay any and all accounts for services, <br /> equipment, and materials used by him and its Subcontractors during the performance of <br /> ' Work under this Contract. The Contractor shall pay such accounts as they become due and <br /> payable. If requested by the City, the Contractor shall promptly furnish proof of payment of <br /> such accounts to the City. <br /> ' 1-05.18(3)D Attention to Work <br /> The Contractor, either in person or acting through its representative, shall give personal <br /> attention to and shall manage the Work so that it shall be prosecuted faithfully and completed <br /> under the Project schedule. When its representative is not personally present at the Project <br /> site, its designated alternate shall be available and shall have the authority to act in matters <br /> relating to this Contract. <br /> ' Where detailed construction requirements are not set forth in the Standard Specifications or <br /> these Special Provisions, the Contractor shall perform the Work of a quality comparable to <br /> the workmanship specified for other parts of the Work, from firms having established good <br /> reputations for similar Work, or by following industry standard practices. The Contractor shall <br /> perform all Work in compliance with and conforming to applicable building codes in effect at <br /> the time the Work is being performed. <br /> 1-05.18(3)E Safety <br /> ' The Contractor alone shall be responsible for safety on the job site, including, but not limited <br /> to, the safety of its and its Subcontractor's employees. The Contractor shall maintain the <br /> Project site and perform the Work in a manner that meets the City's responsibility under <br /> ' statutory and common law for the provision of a safe place to work. <br /> 1-05.18(3)F Threats, Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, <br /> ' or any other agents to threaten bodily injury or property damage, to intimidate or attempt to <br /> intimidate any person, or to assault or physically harass any person. Forbidden conduct <br /> includes, but is not limited to, threatening, appearing, or actually doing any of the following: <br /> pushing, shoving, striking, physically blocking a person or a person's vehicle, vandalism, <br /> malicious mischief, or any other act that a reasonable person would understand be intended <br /> to intimidate, cause personal injury, or cause property damage. Contractor shall remove <br /> ' from the job site any person reasonably under its control or direction who the Contractor or <br /> City reasonably believes violated this section.
