CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-05.18(3)G Weapons Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, <br /> or any other agents or representatives to carry or possess, openly or concealed, explosives <br /> or weapons on the job site, except: (a) such explosives are as reasonably required for <br /> performance of the Work, such as those necessary for blasting or demolition work called for <br /> by the Contract Documents or (b) commissioned law enforcement officers or security <br /> personnel under authority of their commission. A weapon is any object, instrument or <br /> chemical that is (1) designed in such a manner to inflict harm or injury to another person; or <br /> (2) any item used in a manner threatening harm or injury to another person. Weapons <br /> include, but are not limited to, firearms, dangerous knives, dangerous chemicals, tear gas, <br /> martial arts weapons, blackjacks or other weapons. Further, weapons should include those <br /> described in EMC Chapter 10.78. Possession of mace, pepper spray or the like for defensive <br /> purposes is not a violation of this policy. Contractor shall remove from the job site any person <br /> reasonably under its control or direction who the Contractor or City reasonably believes <br /> violated this section. The lack of a request from the City or City's Representative to the <br /> Contractor to remove someone from the job site does not relieve the Contractor from its <br /> obligation to remove someone. <br /> 1-05.18(3)H Safety Standards <br /> The Contractor shall comply with Section 107 of the Contract Work Hours and Safety ' <br /> Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor Regulations <br /> (29 CFR, Part 5). Under this Section, the Contractor shall not require any laborer or <br /> mechanic to work in surroundings or under working conditions that are unsanitary, <br /> hazardous, or dangerous to its health and safety as determined under construction, safety, <br /> and health standards promulgated by the Secretary of Labor. These requirements do not <br /> apply to the purchase of supplies or materials or articles ordinarily available on the open <br /> market, or contracts for transportation or transmission of intelligence. ' <br /> 1-05.18(3)1 Public Safety and Convenience <br /> The Contractor shall conduct its work so as to ensure the least possible obstruction to traffic <br /> and inconvenience to the general public, business, organizations and residents in the vicinity <br /> of the Work and to reasonably protect persons and property. No roads or street shall be <br /> closed to the public except with the permission of the City's Representative and the proper <br /> governmental authority. Fire hydrants on or adjacent to the Work shall be accessible to <br /> firefighting equipment. Temporary provisions shall be made by the Contractor for the use of <br /> sidewalks, private and public driveways and proper functioning of gutters, sewer inlets, <br /> drainage ditches and culverts, irrigation ditches and natural water courses. <br /> 1-05.19 City-Contractor Coordination <br /> (******) <br /> 1-05.19(1) Suggestions to Contractor <br /> Nothing in these Contract Documents requires the City's Representative to provide the Contractor <br /> with direction or advice on how to do the Work, construction practices, or means and methods. If <br /> the City's Representative approves, suggests or recommends any construction practice, means, <br /> method or manner for doing the Work or producing materials, the approval or recommendation <br /> shall not: (A) guarantee that following the method or manner will result in compliance with the <br /> Contract Documents; (B) relieve the Contractor of any risks or obligations under the Contract <br /> Documents; or (C) create liability by the City to the Contractor. <br /> Suggestions as to the plans or methods of accomplishing the Work or Contract requirements by <br /> the City or the City's Representative to the Contractor but not specified or required, if adopted or <br /> followed by the Contractor in whole or in part, shall be used at the risk and responsibility of the <br /> Contractor.
