CITY OF EVERETT SPECIAL PROVISIONS <br /> ' If the scope of such design-related professional services includes work related to pollution <br /> conditions, the Professional Liability insurance shall include Pollution Liability coverage. <br /> If insurance is on a claims made form, its retroactive date, and that of all subsequent <br /> renewals, shall be no later than the effective date of this Contract. <br /> 1-07.18(5)H Builder's Risk <br /> If the Project includes construction of a structure, the Contractor shall maintain property <br /> insurance under an "All Risk Builder's Risk" form in an amount equal to the value of the <br /> structure in a form acceptable to the City. The structure shall have All Risk Builder's Risk <br /> ' Insurance inclusive of earthquake and flood subject to customary industry deductibles. <br /> 1-07.20 Patented Devices, Materials, and Processes <br /> Delete the first paragraph of 1-07.20 and substitute the following: <br /> ' The Contractor shall assume all costs arising from the use of patented devices, materials, or <br /> processes used on or incorporated in the Work, and agrees to indemnify, defend, and save <br /> harmless the City, and its officers, employees and agents from all actions of any nature for, or on <br /> ' account of the use of any patented devices, materials, or processes. <br /> 1-07.23 Public Convenience and Safety <br /> Delete the last sentence of the first paragraph of 1-07.23 and substitute the following: <br /> ' Nothing contained in this Contract is intended to create any third-party beneficiary rights in favor <br /> of the public or any individual utilizing the facilities being constructed or improved under this <br /> Contract. <br /> 1-07.23(1) Construction Under Traffic <br /> Revise the third sentence of the second paragraph to read as follows: <br /> ' Do NOT impair accessibility to existing or temporary pedestrian push buttons. City may allow <br /> activating pedestrian recall timing or other accommodations during construction. <br /> Supplement 1-07.23(1) by adding the following: <br /> ' If Engineer determines the permitted closure hours adversely affect traffic, the Engineer may <br /> adjust the hours accordingly. The Engineer will notify the Contractor in writing of any change <br /> in the closure hours. <br /> ' No lane closures will be allowed on a holiday or holiday weekend, or after 12:00 p.m. on a <br /> day prior to a holiday or holiday weekend. A holiday weekend is defined as having a holiday <br /> fall on Friday, Saturday, Sunday or Monday. <br /> ' Contractor shall provide a uniformed off-duty Police Officer to control traffic in critical <br /> situations as determined by the Engineer. The uniformed officer shall be paid under contract <br /> item "Traffic Control — Off-Duty Police Officer." <br /> ' Contractor shall notify the local Fire, Police and Engineering Departments before the <br /> beginning of each phase of construction so that these agencies may re-route their <br /> emergency vehicles around the construction zone. The non-emergency phone number for <br /> Everett Police is 258-2484, for Fire Dispatch is 257-8757, and for Public Works Engineering <br /> is 257-8800. <br /> Contractor shall notify City of Everett Transit at 425-257-8984 and Community Transit at 425- <br /> 348-7100 of all street closures or delays at least 24 hours in advance to enable rerouting of <br /> buses. <br /> Contractor shall notify the property owners at least 72 hours in advance to enable them to remove <br /> vehicles parked in the vicinity of Work. Towing vehicles shall be the responsibility of the <br /> ' Contractor and no additional payment will be made. <br /> Further supplement 1-07.23(1) by adding the following: <br /> ' SEI to SRI Intertie,SROB Rehab Division 1 —GENERAL REQUIREMENTS WO No.—UP3714 <br /> SP-85 <br />
