CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-07.23(1)A General Requirements Traffic I <br /> (******) <br /> The following general requirements apply to all Work on the Project: <br /> Prepare and submit to Engineer a Traffic Control Plan in accordance with 1-10.2(2) <br /> TRAFFIC CONTROL PLANS. <br /> Refer to 1-08.4(2) SPECIAL CONSTRUCTION CONSTRAINTS regarding construction , <br /> constraints resulting from traffic control. <br /> Notify all affected property owners prior to commencing the barricading of streets, <br /> sidewalks and driveways. , <br /> All business driveways shall remain open except as necessary to permit curing of <br /> construction materials or for short periods of time as required for excavations. However, <br /> at least one driveway per business shall remain open to vehicular traffic at all times <br /> unless otherwise approved by the Engineer and affected property owner in writing. <br /> Signs and barricades shall be supplemented by lanterns or flasher units during the hours <br /> of darkness. <br /> Drivers of motor vehicles used in connection with the construction shall obey traffic rules <br /> posted for such location in the same manner and under the same restrictions as <br /> provided for the drivers of private vehicles. <br /> Conduct the Work, at all-time throughout the project, in such a manner as will obstruct <br /> and inconvenience vehicular and pedestrian traffic as little as possible. Keep the streets, <br /> sidewalks and private driveways open except for the brief periods when actual Work is <br /> being done. <br /> No lane closures will be permitted between 3:30 p.m. and 6:00 p.m., unless specifically <br /> approved by the Engineer. <br /> 1-07.24 Rights of Way <br /> Deletel-07.24 and substitute the following: <br /> Street right of way lines, limits of easements, and limits of construction permits are indicated on <br /> the Plans. The Contractor's construction activities shall be confined within these limits, unless <br /> arrangements for use of private property are made. <br /> Generally, the City will have obtained, prior to bid opening, all rights of way and easements, both <br /> permanent and temporary, necessary for carrying out the Work. Exceptions to this are noted on <br /> the Plans. <br /> Whenever any of the Work is accomplished on or through property other than public right of way, <br /> the Contractor shall meet and fulfill all covenants and stipulations of any easement agreement <br /> obtained by the City from the owner of the private property. Copies of the easement agreements <br /> may be included in the Contract Documents or made available to the Contractor as soon as <br /> practical after they have been obtained by the Engineer. <br /> The Contractor shall not proceed with any portion of the Work in areas where right of way, <br /> easements or rights of entry have not been acquired until the Engineer certifies to the Contractor <br /> that the right of way or easement is available or that the right of entry has been received. If the <br /> Contractor is delayed due to acts of omission on the part of the City in obtaining easements, rights <br /> of entry or right of way, the Contractor will be entitled to an extension of time. The Contractor <br /> agrees that Delay resulting from City obtaining easement or right of entry or right of way shall not <br /> be a breach of Contract. <br /> Each property owner shall be given 48 hours notice prior to entry by the Contractor.
