currently a high demand for student housing near the campus. As acknowledged by ECC <br />witnesses, Mountain View and Cedar Hall are currently 100% occupied with a waitlist of <br />38 students as of the hearing date.5 The Applicant reported that private apartment <br />buildings in the nearby downtown area are fully occupied. Joshua (Josh) Scott, Vice President of Design and Construction for Koz, designed the <br />instant proposal to be consistent with Mountain View Hall, which he also designed. <br />Mountain View Hall was designed to complement the existing campus buildings, <br />incorporating features such as the flat roof in response to the institution. The current <br />project mirrors the design features of Mountain View and Cedar Halls, including gray <br />and white color scheme, large windows, flat roofs, and overall modern style. In the process leading up to the current Koz project proposal, the Applicant attempted to <br />collaborate with the College as they had done for Mountain View Hall. The initial design <br />proposal incorporated the long-range planning of ECC's 2008 Master Plan, which <br />document envisioned the vacation of Little Broadway and a building constructed across <br />the subject property and the right-of-way. The Applicant proposed a student housing <br />building spanning Little Broadway after right-of-way vacation but was informed by the <br />College that the proposal would not be supported. Because the College owns the <br />property abutting the other side of Little Broadway, its no vote killed that design. The <br />Applicant returned to the drawing board to develop a project not reliant on street <br />vacation. Several iterations later, having addressed the property's unique geometry, the <br />Applicant settled on the current proposal. In addition to the permit review process, which <br />included consultation with the City's Police, Fire, and Public Works Departments, the <br />Applicant met with the community in a neighborhood meeting. After the College withdrew its support for the private housing, project, the Applicant <br />offered to sell the property to ECC at cost and had the property professionally appraised. <br />The College did not respond to this offer. The College proposed instead, at some point, <br />to support the project in exchange for an opportunity for first right of refusal over <br />potential tenants through a scheme that included the Applicant providing ECC of all <br />prospective tenants who are ECC students and the Applicant agreeing not to rent to any <br />student that ECC indicated it could accommodate in its own housing.
