NOW, THEREFORE, Owner(s) agree(s) to abide by restrictions on occupation, use, and <br />enjoyment of the Property as follows: <br />1. Owner/Grantor agrees Property will be restricted primarily to housing for college students, <br />except for ground floor retail space as approved in the Decision.. <br />2. This document shall constitute a covenant running with the land and the rights and <br />obligations of the parties hereto shall inure to the benefit of and be binding upon <br />their respective legal representatives, successors and assigns. <br />3. Any change in the occupancy of the building for use other than primarily housing for college <br />students must be approved by the City of Everett. <br />4. Leasing restrictions. The following requirements shall be included in leases for all residential <br />units: <br />a. The Grantor, owner, property manager, or leasing agent shall not lease a <br />residential unit to a tenant who owns, leases, stores, or uses a vehicle for <br />purposes of transit to and/or from the leased premises unless a residential <br />parking stall is available, and the lease assigns that stall to the tenant. Further, <br />such leases must contain a covenant that requires all tenants not to own, lease, <br />store, or use any vehicle for this purpose unless before doing so they obtain an <br />assigned residential parking stall for that vehicle. <br />b. The leases of residential units on the Property shall provide that persons who stay <br />overnight in a unit for more than five (5) days per calendar quarter are considered <br />tenants for purposes of this provision. <br />C. Students or non -students residing within the building are not eligible for the City <br />of Everett residential parking permit for the Residential Parking Zone. <br />5. Quarterly monitoring. Grantor, owner, property manager, or leasing agent shall submit a <br />report within thirty (30) days after the start of each academic quarter of the Everett <br />Community College to City of Everett Community, Planning and Economic Development <br />Department and City Traffic Engineer that reports the following information: <br />a. Certification that tenants are primarily students or were enrolled students at least <br />during some portion of the latest school year; <br />b. The number of tenants (broken down by domestic and international students, and <br />non -students, as applicable); <br />C. The number of tenants (broken down by domestic and international students, and <br />non -students, as applicable) who own, lease, store, or use a vehicle for purposes <br />of transit to and/or from the leased premises; and, <br />d. The number of residential parking stalls the Grantor/property manager has <br />assigned. <br />
