Stay Out of Areas of Prostitution Declaration of Lieutenant Jim Duffy December 2011 I, James Duffy, certify(or declare)under penalty of perjury under the laws of the State of Washington that the following is true and correct: 1. I am a Lieutenant with the Everett Police Department, and have been assigned as the Lieutenant of the Special Investigations section of the Investigations Division since April 2010. 2. I have been a police officer with the Everett Police Department since June 30, 1985. During my service in Everett I have worked as a patrol officer for 10 years, including 7 as a K-9 Officer. I was then assigned as a Narcotics Detective for 4 years,Patrol Sergeant for approximately 1 year and a sergeant at the Drug Task Force for 5 years. This was followed by another year plus as a patrol and ProAct unit sergeant. In June 2008 I was promoted to Lieutenant and worked as a nightshift Watch Commander. In April 2010, I was assigned to the Special Investigations Division. 3. The Special Investigations Division is responsible for investigating crimes including Prostitution and related offenses in the City of Everett. I have been involved in the arrests of prostitutes and people who were attempting to engage the services of prostitutes during my assignment to Special Investigations. During this assignment I have become educated and familiar with the behavior and trafficking patterns of people who would engage in acts of prostitution. 4. During my assignment in the Special Investigations section, I have been made aware of complaints of prostitution activity through a variety of sources, including reports from patrol officers and supervisors,referrals from the Everett Police Department community web page, command-level persons, as well as citizens and business owners in the community. 5. During my tenure in Special Investigations I have participated in several planned operations to contact people who were seeking to engage the services of a prostitute ("John Stings") as well as numerous operations to contact and arrest working prostitutes in various locales within the city of Everett. I also participated in these types of operations during my assignments on patrol and in the ProAct Unit. 6. In early September, 2011 I requested and received information related to 911 calls complaining of Prostitution activity in the City of Everett between January 1, 2010, and the date of my request. In reviewing the dispatch and investigative data, it became clear to me that the entire length of Evergreen Way, from the 4700 block to the south city limits, and the entire area extending from the 1000 block to 41st Street Page 1 of 2
