There are numerous code sections (base code and also state code amendments)that apply to care <br /> facilities and family home care facilities that are allowed to be located within single family dwellings.So <br /> far, none of these appear appropriate(other than Section 308.4.2)to the nature of care provided at <br /> 1706 Broadway.These other sections include: <br /> 308.6 Institutional Group 1-4,day care facilities. Institutional Group 1-4 Occupancy shall include <br /> buildings and structures occupied by more than five persons of any age who receive custodial care for <br /> fewer than 24 hours per day by persons other than parents or guardians, relatives by blood, marriage or <br /> adoption,and in a place other than the home of the person cared for.This group shall include, but not <br /> be limited to,the following: <br /> Adult day care <br /> Child day care <br /> 308.6.5 Family home child care. Family home child care licensed by Washington state for the care of <br /> twelve or fewer children shall be classified as Group R-3 or shall comply with the International <br /> Residential Code. <br /> Based on the definition of family home child care,this exception does not appear to apply to the <br /> medical facility at 1706 Broadway as it is not a day care. <br /> Education Group E Occupancy Section 305.2.4 also contains the (WA ST)family home child care <br /> exception, however that occupancy type is for schools,education, day care facilities, not medical ones. <br /> The limit to the number of persons allowed in this facility is clearly stated in the code as 5 persons <br /> maximum. If more patients are desired,a more appropriate, commercial building should be sought.The <br /> challenges to convert this single-family dwelling to an approved medical facility are significant. <br /> Additionally,the state code does not give the building official or jurisdiction the authority to lessen the <br /> provisions of the state code—the provisions are required whether we personally agree with them or <br /> not. <br /> The only avenues for acceptance that I can see are for the state to change the state codes,or for the <br /> state licensing agency to license the facility as a family home child care center. If the license were in <br /> keeping with the state amendment(up to 12 persons in a single-family dwelling) I would have more <br /> latitude.As I understand it, however,that license is for(traditional)day care and is not appropriate for a <br /> medical care facility with children as provided at this facility. <br /> It may be helpful to submit this evaluation to a licensed architect familiar with medical facilities and/or <br /> the state licensing agency. If I have arrived at the wrong conclusion regarding the occupancy type, I <br /> would appreciate additional guidance. <br /> egi � Page 3 of 3 <br />
