Section 308.4 Institutional Group 1-2. Institutional Group 1-2 occupancy shall include buildings and <br /> structures used for medical care on a 24-hour basis for more than five persons who are incapable of self- <br /> preservation.This group shall include, but not be limited to,the following: <br /> Foster care facilities <br /> Detoxification facilities <br /> Hospice care centers <br /> Hospitals <br /> Nursing Homes <br /> Psychiatric hospitals <br /> Section 308.4.1.1 Condition 1.This occupancy condition shall include facilities that provide nursing and <br /> medical care but do not provide emergency care,surgery,obstetrics,or in-patient stabilization units for <br /> psychiatric or detoxification, including but not limited to nursing homes and foster care facilities. <br /> Section 308.4.2 Five or fewer persons receiving medical care. A facility with five or few persons <br /> receiving medial care shall be classified as Group R-3 or shall comply with the International Residential <br /> Code provided an automatic sprinkler system is installed in accordance with Section 903.3.1.3 or Section <br /> P2904 of the International Residential Code. <br /> Based on the above definitions and occupancy classifications, in 2017 the building at 1706 Broadway <br /> was permitted in compliance with the International Residential Code(IRC) (as per IBC Section 308.4.2). <br /> The code today is the same as in 2017—the allowance to comply with the IRC(same codes as a single- <br /> family residence,greatly reduced code requirements from the requirements of commercial <br /> construction) is a predicated on having 5 or fewer children/babies under care. If we could have <br /> permitted more children,we would have done so at that time. There were several discussions in 2017 <br /> between city staff and the proponents that went over the restrictions placed on the use of the building <br /> by the state codes. <br /> If 6 or more children were to be placed in a building of that type, it would be classified as an 1-2 <br /> Condition 1 occupancy. As a comparison,significant issues that would be required to be addressed <br /> include (note that these are issues from the building codes alone and not including any Land Use or <br /> Public Works requirements): <br /> • The commercial building would have to fully comply with the International Building Code. <br /> o This is commercial construction vs. residential construction,a much higher/different <br /> standard. <br /> • An 1-2 Condition 1 Occupancy may not be in a 2-story building if it is of wood construction. <br /> o The building does not comply. <br /> • The building would be required to be one-hour fire-rated construction throughout. <br /> o The building is not a fire-rated building. <br /> • The building would be required to have a full NFPA 13 sprinkler system. <br /> o The building currently has an NFPA 13d sprinkler system (the type put in houses, not <br /> commercial buildings) <br /> • The building would be required to comply with the current electrical code. <br /> o The building would require a generator and be completely re-wired. <br /> NMI <br /> Page2of3 <br />
