East Marine View Drive, South of 16th Street, prior to approval by the Planning Department of the SEPA/Land Use Application submitted on November 17, 2017. We acknowledge to the City, that Riverview 1, LLC understands the risks associated with submitting the PWP and/or BP prior to approval of the SEPA and Land Use Application, and further understands that submitting for PWP and/or BP does not vest the project or imply that land use approvals will be given. Finally, Riverview I, LLC agrees to hold the City of Everett harmless for the loss of paid application fees, design fees, and other fees that may be incurred if the SEPA/Land Use comments cause the project to be altogether denied, affects the timeframe that creates a feasibility issue related to the project or requires additional design modifications subsequent to submittal of the building permit.
