<br /> issue under Chapter 228, Laws of 1961, of the State of Washington
<br /> (R.C.W. 70.77) , to engage in the branch of pyrotechnics specifi-
<br /> cally designated therein, whether as an importer, exporter or
<br /> wholesaler, retailer, manufacturer, salesman, pyrotechnic or
<br /> agricultural operator, or otherwise.
<br /> Section 9: "Licensee": "Licensee" means any person
<br /> holding a fireworks license in conformance with the Laws of 1961,
<br /> Chapter 228, (R.C.W. 70.77) .
<br /> Section 10: "Permit": "Permit" means the official
<br /> permission granted by the City Council of the City of Everett to
<br /> a licensee for the purpose of establishing and maintaining a
<br /> place where fireworks are manufactured, constructed, produced,
<br /> packaged, stored, sold, exchanged, discharged, or used.
<br /> Section 11: "Package": "Package" includes any case,
<br /> container or receptacle, used for holding fireworks, which is
<br /> closed or sealed by tape, cordage, or by any other means .
<br /> Section 12: "Person": "Person" includes any individual,
<br /> firm, partnership, joint venture, association, concern, corporation,
<br /> estate, trust, business trust, receiver, syndicate, or any other
<br /> group or combination acting as a unit.
<br /> Section 13: "Manufacturer": "Manufacturer" includes
<br /> any person who manufactures, makes, constructs, fabricates or
<br /> produces any fireworks article or device but does not include
<br /> persons who assemble or fabricate sets or mechanical pieces in
<br /> public displays of fireworks .
<br /> Section 14: "Wholesaler": "Wholesaler" includes any
<br /> person, other than an importer, exporter, or manufacturer selling
<br /> only to wholesalers who sells fireworks to a retailer or any
<br /> other person for resale and shall also include any person who
<br /> sells dangerous fireworks to public display permittees .
<br /> Section 15: "Retailer": "Retailer" includes any person
<br /> who, at a fixed location or place of business, sells, transfers,
<br /> or gives fireworks to a consumer or user.
<br /> Section 16: "Salesman": "Salesman" includes any person
<br /> who, as an employee of a manufacturer or wholesaler, solicits,
<br /> accepts or receives an order for fireworks from a licensee or
<br /> permittee.
<br /> Section 17: "Sell", "Transfer": "Sell" or "Transfer"
<br /> includes contracts or orders for sales or transfers .
<br /> Section 18: "Pyrotechnic Operator": "Pyrotechnic
<br /> operator" includes any individual who by experience and training
<br /> has demonstrated the required skill and ability for safety
<br /> setting up and discharging public displays of dangerous fireworks .
<br /> Section 19: "The State Fire Marshals Seal of Regis-
<br /> tration": "The State Fire Marshal 's Seal of Registration" means
<br /> the seal of registration of the State Fire Marshal as defined by
<br /> Chapter 228, Laws of 1961 of the State of Washington, and as used
<br /> by the office of the State Fire Marshal for the registration and
<br /> classification of fireworks as defined by said Laws of the State of
<br /> Washington.
<br /> Section 20: "City Fire Marshal to Enforce and Administer;
<br /> Powers and Duties": The City Fire Marshal of the City of Everett,
<br /> being the chief fire prevention officer of the Everett Fire
<br /> Department, and such other deputies as may be designated by the
