- 't <br /> Chief of the Everett Fire Department, shall enforce this ordinance <br /> and shall keep a file of such regulations and rules relating to <br /> fireworks as the State Fire Marshal may from time to time adopt, <br /> and insofar as this ordinance and the Laws of the State of <br /> Washington permit, he shall use such standards as set forth in the <br /> State fireworks code or law (Chapter 228, Laws of 1961) in enforc- <br /> ing this ordinance. <br /> Section 21: "Acts Prohibited Without Permit": No <br /> person, without securing a permit, shall do any of the following: <br /> (1) Manufacture, import, export, possess, or sell any <br /> fireworks at wholesale or retail for any use, including agricultural <br /> purposes or wild life control; <br /> 2 Discharge dangerous fireworks at any place; <br /> 3 Make a public display of fireworks; <br /> 4 Transport fireworks, except as a public carrier. <br /> Section 22: "Use and Sale of Safe and Sane Fireworks, <br /> Restricted": The retail sale of safe and sane fireworks shall be <br /> limited, as hereinafter set forth. No person shall use or explode <br /> any fireworks within the City of Everett except from 12 :00 o 'clock <br /> noon on the 28th day of June to 12:00 o'clock noon on the 6th <br /> day of July of any year; the only fireworks that may be exploded <br /> within the City of Everett during said period shall be safe and <br /> sane fireworks as herein defined. This shall not apply to duly <br /> authorized displays of fireworks where the same are authorized <br /> pursuant to the Laws of the State of Washington and approved by <br /> the Fire Marshal of the City of Everett, as herein provided . <br /> Section 23: "Application for Permit": Any adult person <br /> or other group desiring to do any act mentioned in Section 21, <br /> shall first make written application for a permit to the Fire <br /> Marshal of the Everett Fire Department, which application shall be <br /> in writing and which shall be made at least 10 days in advance of <br /> the proposed display, if a public display of fireworks is sought. <br /> Section 24: "Investigation, Report on Permit Application: " <br /> It shall be the duty of the Fire Marshal of the City of Everett <br /> to make an investigation and submit a report of his findings and <br /> his recommendations for or against the issuance of the permit, <br /> together with his reasons therefor, to the City Council of the <br /> City of Everett. <br /> Section 25: "City Council May Grant or Deny Permit - <br /> Conditions": The City Council of the City of Everett shall have <br /> power at its discretion to grant or deny the application, subject <br /> to such reasonable conditions, if any, as it may determine to <br /> prescribe. <br /> Section 26: "License Required Prior to Issuance of <br /> Permit": A permit shall not be issued unless the person applying <br /> for the permit has first obtained a license from the State Fire <br /> Marshal, as provided in Chapter 228, Laws of 1961, of the State <br /> of Washington, to do the particular act or acts described in the <br /> permit, unless such license is not required by such act . <br /> Section 27: "Public Display Permit - Investigation - <br /> Grant, Denial - Conditions: " It shall be the duty of the Fire <br /> Marshal of the City of Everett to whom the application for a permit <br /> for a public display of fireworks is made, to make an investigation <br /> as to whether such a display as proposed will be of such a <br /> character and will be so located that it may be hazardous to <br /> property or dangerous to any person, and he shall in the exercise <br /> of reasonable discretion, grant or deny the application, subject <br /> to such reasonable conditions, if any, as he may prescribe. <br /> -4- <br />
