• <br /> 41 <br /> Section : "Fireworks Stands and Retail Outlets" : <br /> All temporary fireworks stands shall conform to the following <br /> minimum standards and conditions : <br /> Temporary fireworks stands shall be erected under the <br /> supervision of the Fire Marshal and need not comply with the build- <br /> ing code of the City of Everett; such temporary fireworks stands <br /> shall be located so as not to be within 50 feet of any gasoline <br /> station, oil storage tank or premises where flammable liquids <br /> are kept or stored; each temporary fireworks stand must have at <br /> lease two exists which shall be unobstructed at all times and <br /> located as far from each other as possible; each temporary fire- <br /> works stand shall have in a readily accessible place a fire <br /> extinguisher that has been approved by the Fire Marshal of the <br /> City of Everett; each stand shall erect "no smoking" signs, which <br /> shall be prominently displayed and no smoking shall be permitted <br /> in or near a temporary stand or any place where fireworks are <br /> stored or sold; Provided further, retail outlets for the sale of <br /> safe and sane fireworks in retail stores or in connection with <br /> the operation of retail stores during public hours where other <br /> merchandise is sold, shall erect "no smoking" signs which shall <br /> be prominently displayed and visible to the public in the area <br /> where said fireworks are sold, and such fireworks shall at all <br /> times during store hours be under the direct supervision of a <br /> clerk or an employee over the age of 21 years who shall remain at <br /> the counter where the fireworks are sold during store hours . <br /> 42 <br /> Section : "Authorized Sales of Toy Pistols, Canes, <br /> Guns, etc . ": 'Toy pistols, toy canes, toy guns or other similar <br /> devices in which paper caps containing not more than twenty- <br /> five hundredths grain of explosive compound for each cap is <br /> used may be sold at all times . <br /> 43 <br /> Section : "Public Displays Not To Be Hazardous" : <br /> All public displays of fireworks shall be of such a character <br /> and so located, discharged, or fired as not to be hazardous or <br /> dangerous to persons or property. <br /> 44 <br /> Section : "Supervision of Public Displays": Every <br /> public display of fireworks shall be handled or supervised by a <br /> competent and experienced pyrotechnic operator approved by the <br /> Fire Marshal or authorized deputy of the Everett Fire Department. <br /> 45 <br /> Section : "Storage Permit Required" : It shall be <br /> unlawful for any person to store fireworks of any class without <br /> first having made a written application for and received a permit <br /> for such storage to the fire marshal of the City of Everett or <br /> such other deputy as may be authorized by the Chief of the Everett <br /> Fire Department; and it shall be the duty of the fire marshal of the <br /> Everett Fire Department to make an investigation as to whether <br /> such storage as proposed will be of such a nature and character <br /> and will be so located as to constitute a hazard to property, or <br /> be dangerous to any person, and said fire marshal, in the exercise <br /> of reasonable discretion, may grant or deny the application <br /> subject to such reasonable conditions as he may prescribe; it <br /> shall be unlawful for any person to store unsold stocks of safe <br /> and sane fireworks remaining unsold after the lawful period of <br /> sale as provided in his permit except in such places of storage <br /> as the fire marshal issuing the permit shall approve . Unsold <br /> stocks of safe and sane fireworks remaining after the authorized <br /> retail sales period shall be returned to the approved storage <br /> facilities of a licensed fireworks wholesaler, to a magazine or <br /> storage place approved by the fire marshal of the City of Everett <br /> Fire Department or to a place approved by the State Fire Marshal. <br /> 7- <br />
