• • 33 Section : "Annual Application for Renewal of Permits": Application for renewal of a permit issued under this ordinance shall be made annually by every person holding an existing permit, and if granted by the City Council, the annual fee as prescribed in this ordinance shall be paid. 34 Section tg: "Permit Authorizes Activities of Registered Salesmen; Employees" : The authorization to engage in the particu- lar act or acts conferred by a permit to a person shall extend to salesmen and other employees of such person who are registered with the City Fire Marshal provided that, a person over the age of 21 years shall at all times be present where fireworks are sold in the City of Everett. 35 Section X : "Annual Permit Fees" : The original and annual renewal permit fees for each permit authorized by this ordinance to be issued, for any of the acts requiring the issuance of a permit as herein provided, shall be the sum of $1O.00. Beginning January 1, 1962 the original and annual renewal permit fee shall be for the calendar year from January 1 to December 31, or for the remaining portion thereof. 35 Section : "Denial of Permit": A written report of the Fire Marshal of the City of Everett or any authorized deputy designated by the Chief of the Everett Fire Department, disclosing that the applicant for a permit or for a renewal of a permit, or the premises for which a permit is to apply, do not meet the qualifications or conditions for same, shall constitute grounds for denial of any application for a permit or the renewal thereof. 37 Section "Hearing on Denial of a Permit": Any applicant who has been denied a permit or renewal of a permit shall be entitled to a hearing before the Fire Prevention Review Board in accordance with Everett City Code, 7.04.090, and the method of appeal shall be in accordance with Section 1.06 (d) 3, of the suggested fire prevention ordinance, adopted by Ordinance No. 3697. 38 Section : "Classification, Registration Prior to Sale, etc . Labels": No fireworks items shall be sold, offered for sale, discharged, or transported within the City of Everett without first having been classified and registered by the State Fire Marshal in accordance with the laws of the State of Washington, Chapter 228, Laws of 1961, as amended. Each item sold as fire- works must be labelled as for sale and distribution together with firing instructions . Every fireworks article which has not been submitted for classification or which does not bear the classification label of the State Fire Marshal shall be considered to be dangerous fireworks . All shipments shall be prepaid. No fireworks shall be sold at retail to the consumer or public unless each package shall be marked as "safe and sane fireworks" and shall bear the State Fire Marshal 's classification label and license number. 39 Section X: "Date Safe and Sane Fireworks May Be Sold" : No safe and sane fireworks shall be sold or offered for sale at retail within the City of Everett except from 12:00 noon, June 28th to 12 :00 noon on July6th of each year. 40 Section .: "Protective Caps or Enclosed Packages Required for Safe and Sane Fireworks": No safe and sane fireworks shall be sold or offered for sale at retail unless the fuses or pther igniting devices are protected and approved protective caps or each item or group of items is enclosed or sealed in a package 'Dearing the state fire marshal 's seal of registration upon which the wholesaler's license number appears . -6-
