• <br /> • <br /> 33 <br /> Section : "Annual Application for Renewal of Permits": <br /> Application for renewal of a permit issued under this ordinance <br /> shall be made annually by every person holding an existing permit, <br /> and if granted by the City Council, the annual fee as prescribed <br /> in this ordinance shall be paid. <br /> 34 <br /> Section tg: "Permit Authorizes Activities of Registered <br /> Salesmen; Employees" : The authorization to engage in the particu- <br /> lar act or acts conferred by a permit to a person shall extend <br /> to salesmen and other employees of such person who are registered <br /> with the City Fire Marshal provided that, a person over the age <br /> of 21 years shall at all times be present where fireworks are sold <br /> in the City of Everett. <br /> 35 <br /> Section X : "Annual Permit Fees" : The original and <br /> annual renewal permit fees for each permit authorized by this <br /> ordinance to be issued, for any of the acts requiring the issuance <br /> of a permit as herein provided, shall be the sum of $1O.00. <br /> Beginning January 1, 1962 the original and annual renewal permit <br /> fee shall be for the calendar year from January 1 to December 31, <br /> or for the remaining portion thereof. <br /> 35 <br /> Section : "Denial of Permit": A written report of <br /> the Fire Marshal of the City of Everett or any authorized deputy <br /> designated by the Chief of the Everett Fire Department, disclosing <br /> that the applicant for a permit or for a renewal of a permit, or <br /> the premises for which a permit is to apply, do not meet the <br /> qualifications or conditions for same, shall constitute grounds <br /> for denial of any application for a permit or the renewal thereof. <br /> 37 <br /> Section "Hearing on Denial of a Permit": Any <br /> applicant who has been denied a permit or renewal of a permit shall <br /> be entitled to a hearing before the Fire Prevention Review Board <br /> in accordance with Everett City Code, 7.04.090, and the method of <br /> appeal shall be in accordance with Section 1.06 (d) 3, of the <br /> suggested fire prevention ordinance, adopted by Ordinance No. <br /> 3697. <br /> 38 <br /> Section : "Classification, Registration Prior to Sale, <br /> etc . Labels": No fireworks items shall be sold, offered for sale, <br /> discharged, or transported within the City of Everett without <br /> first having been classified and registered by the State Fire <br /> Marshal in accordance with the laws of the State of Washington, <br /> Chapter 228, Laws of 1961, as amended. Each item sold as fire- <br /> works must be labelled as for sale and distribution together with <br /> firing instructions . Every fireworks article which has not been <br /> submitted for classification or which does not bear the classification <br /> label of the State Fire Marshal shall be considered to be <br /> dangerous fireworks . All shipments shall be prepaid. No fireworks <br /> shall be sold at retail to the consumer or public unless each <br /> package shall be marked as "safe and sane fireworks" and shall <br /> bear the State Fire Marshal 's classification label and license <br /> number. <br /> 39 <br /> Section X: "Date Safe and Sane Fireworks May Be Sold" : <br /> No safe and sane fireworks shall be sold or offered for sale at <br /> retail within the City of Everett except from 12:00 noon, June 28th <br /> to 12 :00 noon on July6th of each year. <br /> 40 <br /> Section .: "Protective Caps or Enclosed Packages <br /> Required for Safe and Sane Fireworks": No safe and sane fireworks <br /> shall be sold or offered for sale at retail unless the fuses or <br /> pther igniting devices are protected and approved protective caps <br /> or each item or group of items is enclosed or sealed in a package <br /> 'Dearing the state fire marshal 's seal of registration upon which <br /> the wholesaler's license number appears . <br /> -6- <br />
