The Investigating Agency may determine that it is necessary to obtain a DNA sample <br /> from an individual other than the potential suspect (e.g., an individual who has been <br /> determined to be genetically related to the potential suspect) to further IGG. Such <br /> samples will be obtained legally, and in appropriate circumstances,the Investigating <br /> Agency shall obtain signed consent from that individual as required by FamilyTreeDNA <br /> to process the sample. <br /> 6. Except as required by law, the Investigative Agency or any representative or contract <br /> agency will not publicly disclose information as it pertains to the use of Gene By <br /> Gene/FamilyTreeDNA Services, including posting or discussing on social media <br /> platforms, prior to an arrest of a suspect or the identification of remains. <br /> USE OF INVESTIGATIVE GENETIC GENEALOGY DATA (Please initial that you have read and agree.) <br /> 7. 06- The Investigating Agency will only use data obtained from IGG for the <br /> identification of a suspect or victim in a crime involving child abduction, sexual assault <br /> and/or homicide, or to identify human remains and for no other purpose. <br /> 8. - a C Once the Investigating Agency has identified a suspect as a result of IGG and <br /> has confirmed that identification by STR DNA testing through a legally-obtained sample, <br /> the Investigating Agency will download and maintain a copy of all information uploaded <br /> to a genealogical website, remove the crime scene forensic unknown DNA and account <br /> profile from the genealogical website, and refrain from releasing names of matches <br /> without a lawful court order or as required by law. <br /> 9. C () The Investigating Agency agrees that, so long as consistent with the law and <br /> in order to protect privacy, it will not include in any Warrant or Probable Cause <br /> Declaration the names of persons identified as possible or putative relatives of the <br /> forensic unknown learned during IGG. In constructing the family histories necessary to <br /> identify possible suspects or unidentified remains, law enforcement and those who <br /> contract to work with them will learn the identities of many persons including some <br /> who, while related, have no knowledge of the individual identified as the forensic <br /> unkown. Most will have no connection to the crimes being investigated. These names, <br /> used only for developing investigative leads,will not be released except through a valid <br /> court order or as mandated by statutory or case law. If the name(s) of a genetic witness <br /> is disclosed in court documents or a proceeding, the agency will take measures to notify <br /> the individual(s) prior to the release of such information. <br /> C10. 0 �= The Investigating Agency will not use any DNA data in violation of the terms <br /> of this TOS. <br /> 11.
