• <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent was in violation of IPMC 106.1 and EMC <br /> 8.20.020(A)(C) and is hereby ordered to: <br /> 1. The Respondent must abate all violations of IPMC 106.1 and EMC 8.20.020(A)(C) <br /> on the property at 4841 Glenwood Avenue, Everett, Washington. <br /> 2. All abatement of the nuisance violations on said property must be completed by <br /> April 19, 2016, unless otherwise stated. The abatement shall include: <br /> a. The Respondent shall either properly store in an enclosed area or remove and <br /> properly dispose of all discarded items on the property. <br /> b. The Respondent shall maintain the property free of nuisances including <br /> discarded household items, broken furniture, junk, debris and trash. Approved <br /> garbage containers with tight fitting lids shall be used to store garbage and <br /> refuse on the property. <br /> c. The Respondent shall apply for and obtain all of the necessary and required <br /> permits to bring the property and residential structure into compliance with City <br /> ordinances. The Respondent shall conduct and complete all of the required <br /> work and have the work inspected and approved by the City of Everett Building <br /> Division by June 17, 2016. City of Everett Building Official shall have discretion 1 <br /> to extend the compliance date. Among the items in exercising this discretion he <br /> may consider time restrictions that the Respondent encounters to support an <br /> extension. Any violations not listed in this Order are subject to standard <br /> enforcement processes and procedures. <br /> d. The Respondent shall clean out the catch basins on the property immediately <br /> and in doing so work with the City of Everett Building Division. <br /> e. The residential structure on the property shall remain vacant until a certificate of <br /> occupancy is issued to the Respondent by the City of Everett Building Division. <br /> 3. The Respondent shall be fined $500.00 for each violation of IPMC 106.1 and EMC <br /> 8.20.020 (A)(C) for a total fine of$1000.00. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondent shall pay the $1000.00 fine no later than April 1, 2016. Payment <br /> shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, Everett <br /> Washington, 98201.
