• <br /> /7 5 <br /> For the purpose of this code, any structure or premises that have any or all of the <br /> conditions or defects described below shall be considered dangerous: <br /> (5) The building or structure, or part of the building or structure, because of <br /> dilapidation, deterioration, decay, faulty construction, the removal or movement <br /> of some portion of the ground necessary for the support, or for any other <br /> reason, is likely to partially or completely collapse, or some portion of the <br /> foundation underpinning of the building or structure is likely to fail or give way. <br /> 3. IPMC 106.1 Unlawful Acts, which reads: <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in <br /> violation of any of the provisions of this code. <br /> 4. EMC 8.20.020 (A)(C)(G) Nuisances, which reads: <br /> Except as authorized by subsection H of this section or as may be allowed by <br /> another city ordinance, no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall maintain <br /> or allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible from <br /> any street, alley, or other public or private properly: <br /> (A)Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials. <br /> (C)Broken or discarded furniture, household equipment and furnishings; <br /> Conclusions of Law Based on Above Findings: <br /> 1. An ecology block retaining wall on the property was constructed contrary to City <br /> ordinance and without City approval. The retaining wall structure has failed and is <br /> in risk of collapse thereby rendering the structure as dangerous as defined by IPMC <br /> 108.1.5(5) and in violation of IPMC 106.1. The Respondent violated said City <br /> ordinance. <br /> 2. The residential structure and ecology block retaining wall that were constructed on <br /> the property had not been inspected and given final approval by the City of Everett <br /> Building Division. They are unlawful as defined by IPMC 108.1.4 and in violation of <br /> IPMC 106.1. The Respondent violated said City ordinance. <br /> 3. Household items, broken furniture, junk, debris and trash discarded in the open <br /> carport and driveway of the property in public view are violations of EMC <br /> 8.20.020(A)(C). These violations are public nuisances. The Respondent violated <br /> said City ordinances. <br />
