• • <br /> 2I <br /> Exhibit 12 Letter from JRR Engineering Inc. dated September 30, 2009 <br /> Based upon a review of the administrative hearing record, the following Findings of Fact <br /> and Conclusions of Law hereby constitute the basis of the decision of the Everett <br /> Violations Hearing Examiner. <br /> l <br /> FINDINGS OF FACT <br /> 1. US Bank Trust National Association Trustee, is the owner of property at 4841 <br /> Glenwood Avenue, Everett, Washington (property) which is in an R-1, Single Family <br /> Detached Low Density Residential zone as established by the City of Everett. <br /> (Exhibit#8, Snohomish County Assessors Record dated March 10, 2016) (Exhibit <br /> #9, Go Sync Maps) <br /> 2. On December 11, 2015, during an inspection of the property, City of Everett Code <br /> Enforcement Officer Kevin Fagerstrom observed and photographed household <br /> items, broken furniture,junk, debris and trash that had been discarded in the open <br /> carport and driveway in public view of the property. Such violations are an <br /> annoyance and disrupt and injure the comfort, repose, health and safety of others. <br /> The entire community is affected by the activity. He also observed that the <br /> residential structure on the property was vacant and foreclosure documents had <br /> been posted on the structure. Officer Fagerstrom contacted the City of Everett <br /> Building Division for further review of structures on the property. (Exhibit#2a-2f, <br /> Inspection Photos dated December 11, 2015) (Testimony of Code Enforcement <br /> Officer Fagerstrom) <br /> 3. On December 14, 2015, Tony Lee, City of Everett Building Division Building Official, <br /> inspected the property and observed that the residential structure on site was <br /> vacant. A retaining wall was vertical in several places which required a batter (the <br /> measure of the wall from a vertical plane)for the design. Upon review of City <br /> records, Mr. Lee discovered that final approvals for the residential structure and the <br /> retaining wall had never been given by the City. (Exhibit#7, Letter from Tony Lee <br /> dated December 28, 2015) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 4. Mr. Lee returned to the property on December 17, 2015 with Steve Miller, City of <br /> Everett Associate Engineer, to conduct a reinspection of the residential structure <br /> and ecology block retaining wall that had been constructed on the property. The <br /> following conditions were observed: <br /> a. The ecology block retaining wall showed signs of settling and had no visual <br /> batter as required by that type of design. Thirty linear feet of the wall had a <br /> batter of zero to less than 1 inch over the height of the wall rather than the 7.5 <br /> inches required. 1 <br /> b. The ground at the top and bottom of the retaining wall showed signs of settling <br /> and movement. <br /> 6 <br />
