• <br /> 3/ 7 <br /> Upon review of City records, Mr. Lee discovered the following additional information <br /> pertaining to the retaining wall and residential structure that were constructed on the <br /> property: <br /> c. The retaining wall was higher than the four feet maximum height as permitted <br /> by the approved site plan. <br /> d. The extent and layout of the driveway and ecology block retaining wall <br /> exceeded what had been approved by the site plan. <br /> e. The retaining wall had never received final approval by the City of Everett <br /> Building Division. <br /> f. The retaining wall had failed in 2007, was repaired but never received final <br /> approval by the City. <br /> g. A review of City records revealed a letter from JRR Engineering dated <br /> September 30, 2009 that confirmed the retaining wall had not been built <br /> correctly. <br /> h. The fire apparatus access road had not been constructed per the approved site <br /> plan. <br /> i. An additional garage had been constructed under the deck on the SE corner of <br /> the residential structure on the property without approvals by the City. <br /> j. The adjacent grounds to the entry porch area were not built to the approved <br /> plans. Steps and guards are required and the retaining wall supporting the <br /> entry patio had not been inspected or approved. <br /> k. The residential structure had not received a certificate of occupancy from the <br /> City and building permits have expired without final approvals from the City of <br /> Everett Building Division. <br /> (Exhibit#7, Letter from Tony Lee dated December 28, 2015) (Testimony of Code <br /> Enforcement Officer Fagerstrom) <br /> 5. On December 18, 2015, the City issued a violation citation to the Respondent for <br /> violations of International Property Maintenance Code (IPMC) 106.1 Unlawful Acts <br /> as adopted by EMC 16.005.010; IPMC 108.1.4 Unlawful Structure as adopted by <br /> EMC 16.005.010; IPMC 108.1.5(5) Dangerous Structure or Premises as adopted by <br /> EMC 16.005.010 and Everett Municipal Code (EMC) 8.20.020(A)(C) Nuisances. <br /> Copies were mailed to the Respondent via first class and certified mail to the <br /> Respondents last known address which Officer Fagerstrom obtained from <br /> Snohomish County Assessors Record. A copy was posted on the property. Each <br /> method of service used is independently sufficient to provide notice. (Pursuant to <br /> EMC 1.20.010.C.1) (Exhibit#4, Violation Citation dated December 18, 2015 with <br /> mail receipts) (Exhibit#5, Declaration of Service dated December 18, 2015 with <br /> photo) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 6. On December 18, 2015, a notice of condemnation was sent via first class and <br /> certified mail to the Respondent. The notice informed the Respondent of the <br /> violations present on the property and cited that the engineered concrete block <br /> retaining wall constructed on the property has failed and the residential structure <br /> must remain vacant until a certificate of occupancy is issued by the City of Everett <br />
