18.5 Waiver <br /> A. No waiver of one right or remedy shall act as a waiver of any other right or remedy or as a <br /> subsequent waiver of the same right or remedy. <br /> B. The waiver by either party of any term or condition of this Contract shall not be deemed <br /> to constitute a continuing waiver thereof nor of any further or additional right that such <br /> party may hold under this Contract. <br /> 18.6 City of Everett Business License <br /> A. Contractor agrees to obtain a City of Everett business license prior to performing any Work <br /> pursuant to this Contract. <br /> 18.7 Compliance with Federal, State and Local Laws <br /> A. Contractor shall comply with and obey all federal, state and local laws, regulations, and <br /> ordinances applicable to the operation of its business and to its performance of Work <br /> hereunder. If, and to the extent, this Contract receives financial assistance from federal, <br /> state or private agencies, Contractor shall comply with all terms and conditions prescribed <br /> for third party contracts in the grant and all said terms and conditions shall be deemed <br /> incorporated in the Contract Documents. Terms and conditions of any such grant take <br /> precedence over conflicting terms and conditions in the Contract Documents. <br /> 1. Title VI Assurance <br /> a. The Contractor, with regard to the Work performed during the Contract, shall not <br /> discriminate on the grounds of race, color, sex or national origin in the selection <br /> and retention of Subcontractors, including procurement of materials and leases <br /> of equipment. The Contractor shall not participate either directly or indirectly in <br /> such discrimination, including discrimination in employment practices. <br /> b. In all solicitations either by competitive bidding or negotiations made by the <br /> Contractor for Work to be performed under a subcontract, including <br /> procurement of materials or leases of equipment, each potential Subcontractor <br /> or suppler shall be notified by the Contractor of the Contractor's obligations <br /> under this Contract. <br /> c. The Contractor shall provide all information and reports required by federal <br /> regulations applicable to this Contract. The Contractor shall permit access to its <br /> books, records, accounts, other sources of information, and its facilities as may <br /> be determined by the Owner to be pertinent to ascertain compliance with <br /> applicable federal regulations. Where any information required of a Contractor is <br /> in the exclusive possession of another who fails or refuses to furnish this <br /> information, the Contractor shall so certify to the Owner, and shall set forth what <br /> efforts it has made to obtain the information. <br /> d. In the event of the Contractor's noncompliance with the nondiscrimination <br /> provisions of this Contract, the Owner shall impose such Contract sanctions as it, <br /> or the Owner's funding agencies, may determine to be appropriate, including, but <br /> not limited to: (a) withholding of payments to the Contractor until the Contractor <br /> complies, and (b) termination or suspension of the Contract, in whole or in part. <br /> Replacement of Reservoir 2 General Conditions <br /> WO# UP3658 00 72 13 - 83 <br />
