Ii state what hours are being requested, and why. Requests shall be submitted for <br /> 2 review no later than ***72 hours for day work and 30 days for night work*** prior to <br /> 3 the day(s) the Contractor is requesting to change the hours. <br /> 4 <br /> 5 A Noise Variance, which shall be provided by the City, is required for Contract <br /> 6 nighttime work and included as an appendix in these specifications. If the Contractor <br /> 7 or the Engineer requests to do nighttime work that is not already established in the <br /> I 8 Contract, a 30 day notice is required. The Engineer will then review the request and <br /> 9 apply for the Noise Variance; the City can deny the request at its sole discretion. <br /> 10 Nighttime work is considered to be between 10 pm and 7 am unless otherwise stated. <br /> 111 11 The following mitigation measures shall be in effect during a Noise Variance, though <br /> 12 there may be additional project specific requirements: <br /> 13 • Back-up alarms shall be directional broad band type alarms. <br /> I 14 • Trucks performing export haul shall have well maintained bed liners. <br /> 15 • Tailgate slamming will be prohibited. <br /> 16 • No construction work shall be allowed between 6 pm and 8 am on Saturdays, <br /> I <br /> 17 18 Sundays, or federally-recognized holidays unless otherwise stated in the <br /> Noise Variance Permit. <br /> 19 <br /> 20 If the Contracting Agency approves such a deviation, such approval may be subject <br /> I21 to certain other conditions, which will be detailed in writing. For example: <br /> 22 <br /> 23 1. On non-Federal aid projects, requiring the Contractor to reimburse the <br /> Il 24 Contracting Agency for the costs in excess of straight-time costs for <br /> 25 Contracting Agency representatives who worked during such times. (The <br /> 26 Engineer may require designated representatives to be present during the <br /> I 27 work. Representatives who may be deemed necessary by the Engineer <br /> 28 include but are not limited to: survey crews; personnel from the Contracting <br /> 29 Agency's material testing lab; inspectors; and other Contracting Agency <br /> I 30 employees or third party consultants when, in the opinion of the Engineer, <br /> 31 such work necessitates their presence.) <br /> 32 2. Considering the work performed on Saturdays, Sundays, and holidays as <br /> I 33 working days with regard to the contract time. <br /> 34 3. Considering multiple work shifts as multiple working days with respect to <br /> 35 contract time even though the multiple shifts occur in a single 24-hour period. <br /> 36 4. If a 4-10 work schedule is requested and approved the non-working day for <br /> I37 the week will be charged as a working day. <br /> 38 5.
