committed in the Property. Except to the extent this Lease specifically states otherwise, <br /> EGM is responsible for maintenance of the Property during the term of the Lease. <br /> Section 11. ALTERATIONS AND FIXTURES/SIGNS. EGM shall not make or <br /> permit to be made any alterations,additions, improvements or installations in or to the <br /> Property, or place signs or other displays visible from outside of the Property <br /> (individually and collectively "EGM Alterations"), without first obtaining the consent of <br /> City, which may be withheld in City's sole discretion. All EGM Alterations performed <br /> by EGM shall be (a)completed in accordance with the plans and specifications approved <br /> by City; (b)completed in accordance with all applicable law(including,without <br /> limitation, Chapter 39.12 RCW); (c) carried out promptly in a good and workmanlike <br /> manner; (d) completed with all new materials; and (e) free of defects in materials and <br /> workmanship. <br /> Section 12. TERMINATION. The City may terminate this Lease at any time and for <br /> any reason upon 30-days prior written notice to EGM. The City may also terminate this <br /> Lease effective upon written notice to EGM in the event of material breach of this Lease. <br /> These rights are in addition to any other rights at law or in equity. <br /> Section 13. NON-INTERFERENCE WITH CITY USE. EGM's use of the <br /> Property shall not interfere in any way with any City use of the Property, including <br /> utilities and travel. <br /> Section 14. HAZARDOUS MATERIALS. EGM shall not cause or permit any <br /> storage,use, sale,release, generation or disposal any materials on the Property that are <br /> classified as hazardous or dangerous under the Washington Model Toxic Control Act or <br /> any other applicable environmental law; provided, however, EGM shall be permitted <br /> without notice or the City's written consent to handle, store, use or dispose of products <br /> containing small quantities of such hazardous or dangerous materials, such as ordinary <br /> cleaning and ordinary maintenance products used by EGM for cleaning and maintenance <br /> in the reasonable and prudent conduct of the Project on the Property. <br /> Section 15. SURRENDER. EGM shall, at the expiration or earlier termination of this <br /> Lease, surrender and deliver the Property to the City (i) in as good condition as when <br /> received by EGM from the City,reasonable use and wear excepted, and(ii) free from any <br /> tenancy or occupancy by any person. <br /> Section 16. COMPLIANCE WITH LAW. EGM agrees to comply with all <br /> applicable federal, state, and local laws and regulations and, unless otherwise agreed in <br /> writing by the City,to acquire all permits required by law or regulation. EGM shall not <br /> do anything or suffer anything to be done in or about the Property which will in any way <br /> violate or conflict with any such federal, state, and local laws and regulations. <br /> 4 <br />
