"Contract" shall mean any agreement between the City and the Agency that <br /> incorporates this Agreement by reference. <br /> K. "Contractor" shall mean an entity that agrees to provide the amount and kind of <br /> services requested; provides services only for those determined to be eligible; and <br /> provides services on a fee-for-service and/or per-unit basis with contractual penalties <br /> if it fails to meet program performance standards. <br /> L. "Debarment" shall mean an action taken by a federal official to exclude a person or <br /> business entity from participating in transactions involving certain federal funds. <br /> M. "Director" shall mean the Director of the City's Community Development Division <br /> and/or the delegate authorized in writing to act on the Director's behalf. <br /> N. "Equipment" shall mean an article of nonexpendable, tangible personal property or <br /> information technology systems and software having a useful life of more than one (1) <br /> year and an acquisition cost of$5,000 or more per unit. <br /> O. "HIPAA" shall mean the Health Insurance Portability and Accountability Act of 1996 <br /> (Pub. L. No. 104-191, 79 Stat. 1936), as codified at 42 U.S.C. §§ 1320d-d8, and its <br /> implementing regulations set forth at 45 CFR Parts 160 and 164. <br /> P. "Nonexpendable personal property" shall mean tangible personal property having a <br /> useful life of more than one (1) year and an acquisition cost of$500 or more per unit. <br /> Q. "OMB" shall mean the federal Office of Management and Budget. <br /> R. "OMB Uniform Guidance" shall refer to 2 CFR Part 200 Uniform Administrative <br /> Requirements, Cost Principles, and Audit Requirements for Federal Awards. <br /> S. "Personal Information" shall mean information identifiable to any person, including, but <br /> not limited to, information that relates to a person's name, health, finances, education, <br /> business, use or receipt of governmental services or other activities, addresses, <br /> telephone numbers, social security numbers, driver license numbers, other identifying <br /> numbers, and any financial identifiers. <br /> T. "Personal property" shall mean property of any kind except real property. <br /> U. "RCW" shall mean the Revised Code of Washington. All references to RCW chapters <br /> or sections shall include any successor, amended, or replacement statute. Pertinent <br /> RCW chapters and sections can be accessed at http://sic.leg.wa.gov/. <br /> V. "Real property" shall mean any interest in land, including land improvements, <br /> structures, and appurtenances thereto, excluding movable machinery and equipment. <br /> W.
