Dogwood-Elm Creek flows north/south just to the west of the parcels. There is a wetland <br /> between the creek and a steep slope along the western edge of both parcels. The <br /> Applicant submitted both a critical area report categorizing and discussing the wetland <br /> and stream, and a geotechnical engineering report addressing the steep slope and any <br /> potential for geological hazards on the site. These reports were accepted by the City as <br /> adequately meeting study requirements imposed by the critical areas ordinance(CAO). <br /> According to these studies,the Category IV wetland has a habitat score of five points and <br /> requires a 44-foot buffer pursuant to the CAO. Everett Municipal Code (EMC) <br /> 19.37.110.A.1(d). A 25-foot buffer is required from the steep slope, and a 50-foot buffer <br /> is required from the off-site creek;however, of the three,the wetland buffer intrudes the <br /> farthest east into the subject parcels and is therefore the critical area buffer limit used in <br /> analyzing the instant proposal. The subject property is zoned R-1, Single Family Detached Low Density residential and : <br /> has a Comprehensive Plan land use designation of 1.2, Single Family Detached/5-10 <br /> units per acre. All surrounding parcels share the site's R-1 zoning. Parcels to the south <br /> and west are developed with single-family residential uses. Dogwood Drive is to the <br /> east. To the north is the Early Learning Center, also owned at the time of hearing by <br /> Carlos Chaves-Velando. Exhibits 1 and 15; Carlos Chaves-Velando Testimony. <br /> 5. Churches are allowed in the R-1 zone subject to special property use review and <br /> approval. An expansion of an existing church by 25%or more of the building area is also <br /> subject to special property use approval through a Review Process III. EMC <br /> 19.41.150.B;EMC Chapter 19.05, Table 5.2. <br /> 6. The R-1 zone requires a minimum of 6,000 square feet of lot area,minimum 50-foot lot <br /> width, and minimum 80-foot lot depth. Maximum structure height allowed is 28 feet. <br /> Minimum setbacks are 20 feet from front and rear lot lines, 10 feet from side street lot <br /> lines, and five feet from interior side lot lines. However,pursuant to EMC <br /> 19.41.150.D.2.b,churches must be setback at least 15 feet from shared property lines <br /> abutting residential uses. Since its <br /> establishment,there have been some minor additions to the building and various <br /> renovations. View Ridge Community Church was established on-site in 2002. The <br /> church building, approximately 3,421 square feet in area,takes access from two <br /> driveways onto Dogwood Drive,a paved street with sidewalks on both sides. There is an <br /> Everett Transit bus stop in front of the church on Dogwood Drive. Exhibit 1. <br /> 8. In order to have enough space for classrooms and youth programs,the proposal would <br /> add a two story addition of 3,540 square feet to the south and west of the existing church <br /> building,resulting in a total size of 6,961 square feet.
