i <br /> City of Everett 00 2113 - 5 <br /> 2021 Trickling Filter Media Replacement UP 3742-3 <br /> 1.10 LIST OF SUBCONTRACTORS <br /> A. Bidder shall complete SECTION 00 4336 — PROPOSED SUBCONTRACTORS <br /> FORM and submit it with the Bid. <br /> 1.11 REJECTION OF ANY AND ALL BIDS <br /> A. The City reserves the right to reject any and all Bids. <br /> 111 1.12 RETURN OF BID SECURITY <br /> A. Within 15 calendar days after the Bids are opened, the City will return the bid <br /> security accompanying the Bids that are not to be considered in making the <br /> award. All other bid securities will be held until the Contract has been fully <br /> U <br /> executed; after which they will be returned to the respective Bidders whose Bids <br /> they accompanied. <br /> 1.13 AWARD OF CONTRACT <br /> A. Evaluation of Bids <br /> 1. Bids will be evaluated by the City to determine which bid is the lowest <br /> responsive bid by a responsible bidder and which bid, if any, should be <br /> ' accepted in the best interest of the City. The City, in its sole discretion, <br /> reserves the right to accept or reject any and all bids submitted and to waive <br /> informalities and minor irregularities. <br /> a. LOWEST: The City will award the Project to the responsive and <br /> responsible bidder whose Bid is the lowest. In accordance with RCW <br /> 39.04.380, if a bid is received from a nonresident contractor from a <br /> state that provides an in-state percentage bidding preference and <br /> does not have an office located in Washington, then a comparable <br /> percentage disadvantage will be applied to the bid of that nonresident <br /> contractor. <br /> b. RESPONSIVENESS: City will consider all the material submitted by <br /> the bidder to determine whether it is in compliance with the Contract <br /> L Documents. The City reserves the right, at its discretion, to reject <br /> nonresponsive Bids. <br /> c. RESPONSIBILITY: <br /> 1) Mandatory Responsibility Criteria: RCW 39.04.350(1). It is the <br /> intent of City to award a contract to the lowest responsive and <br /> responsible Bidder. Before award, the Bidder must meet the <br /> Bidder responsibility criteria under this Section to be considered <br /> a responsible Bidder. The Bidder may be required by the City to <br /> submit documentation demonstrating compliance with the <br /> criteria under this Section.
