I <br /> City of Everett 00 2113 - 4 I <br /> 2021 Trickling Filter Media Replacement UP 3742-3 <br /> be in full compliance with these Instructions to Bidders. Bid security shall be in I <br /> an amount sufficient for the Bid as resubmitted. <br /> B. After the scheduled time for opening Bids, no Bidder will be permitted to withdraw I <br /> his Bid unless the award of contract is delayed for a period exceeding 60 calendar <br /> days. <br /> C. Bids received after the scheduled closing for opening Bids shall be returned to I <br /> the Bidder unopened. <br /> D. Within 5 days after the opening of Bids, a Bidder who wishes to claim error after I <br /> the Bids have been opened and tabulated shall submit a notarized affidavit <br /> signed by the Bidder, accompanied by original work sheets used in the <br /> preparation of the Bid, requesting relief from the responsibilities of award. The <br /> affidavit shall describe the specific error(s) and certify that the work sheets are <br /> the originals used in the preparation of the Bid. City staff will review the certified I <br /> work sheets to determine the validity of the claimed error and make a <br /> recommendation. If the City concurs in the claim of error, the Bidder will be <br /> relieved of responsibility, and the bid security of the Bidder will be returned. I <br /> Thereafter, at the discretion of the City, all Bids may be rejected or award made <br /> to next lowest and responsive Bidder. At the discretion of the City, Bidders <br /> claiming error may or may not be allowed to participate in the re-bid. I <br /> 1.9 BID SECURITY I <br /> A. Bid Security in the amount of at least 5 percent of the Total Bid shall accompany <br /> each Bid. This security may be by certified check, cashier's check, or a bid bond IIImade payable to the City of Everett. A bid bond shall be on the form provided in <br /> the Contract Documents. A bid bond shall not be conditioned to modify the <br /> minimum 5-percent required. The surety shall: (1) be registered with the I <br /> Washington State Insurance Commissioner, and (2) appear on the current <br /> Authorized Insurance List in the State of Washington published by the Office of <br /> the Insurance Commissioner. <br /> B. The failure to furnish a bid security of a minimum of 5 percent shall make the Bid <br /> nonresponsive and shall cause the Bid to be rejected by the City of Everett. I <br /> C. Bid security shall serve as evidence of good faith and as a guarantee that if <br /> awarded the Contract the Bidder will execute the Contract and provide bonds as <br /> required by the Bid. Should the successful Bidder fail to enter into the Contract, <br /> furnish a satisfactory performance and payment bond, and furnish evidence of <br /> insurance within 14 calendar days after the award date, the certified check, <br /> cashier's check or bid bond shall be forfeited as liquidated damages. <br /> I <br /> 00 2113 - 4 INSTRUCTIONS TO BIDDERS I <br />
