A <br /> 1 ORDINANCE NO. 3837 <br /> 2 AN ORDINANCE providing for the improvement of: <br /> 3 21st STREET FROM BAKER AVENUE TO CEDAR STREET <br /> 4 by the construction of an asphaltic concrete pavement, thirty- <br /> six feet (36' ) in width, by the construction of Portland cement <br /> 5 curbs and gutters on both sides of the street, by the construction <br /> or reconstruction where necessary of all drainage facilities, <br /> 6 sewers, side sewers, sidewalks, water mains and hydrants with <br /> necessary appurtenances, by such grading or regrading as may be <br /> 7 necessary and doing such other work as may be necessary in <br /> connection therewith to make a complete improvement, all in <br /> 8 accordance with plans to be prepared by the City Engineer. The <br /> City of Everett Street Department will excavate the roadway and <br /> 9 place and rough grade all the gravel back fill (selected roadway <br /> borrow) . The local improvement district will do all other work <br /> 10 including furnishing and placing crushed stone surfacing, rolling <br /> and fine grading to prepare the road for the placing of the <br /> 11 asphaltic concrete pavement . Creating a local improvement <br /> district; creating a local improvement district fund therefor; and <br /> 12 providing for the payment of said improvement by special assess- <br /> ments on the property in said district under the mode of payment <br /> 13 by bonds . <br /> 14 NOW, THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> 15 Section 1: That an improvement be made of: <br /> 16 21st STREET FROM BAKER AVENUE TO CEDAR STREET <br /> 17 by the construction of an asphaltic concrete pavement, thirty- <br /> six feet (36' ) in width, by the construction of Portland cement <br /> 18 concrete curbs and gutters on both sides of the street, by the <br /> construction or reconstruction where necessary of all drainage <br /> 19 facilities, sewers, side sewers, sidewalks, water mains and <br /> hydrants with necessary appurtenances, by such grading or re- <br /> 20 grading as may be necessary and doing such other work as may be <br /> necessary in connection therewith to make a complete improvement, <br /> 21 all in accordance with plans to be prepared by the City Engineer. <br /> The City of Everett Street Department will excavate the roadway <br /> 22 and place and rough grade all the gravel back fill (selected <br /> roadway borrow) . The local improvement district will do all <br /> 23 other work including furnishing and placing crushed stone surfac- <br /> ing, rolling and find grading to prepare the road for the placing <br /> 24 of the asphaltic concrete pavement . <br /> 25 Section 2: That the cost and expense of such improvement <br /> including all necessary incidental expenses of such improvement, <br /> 26 including all necessary incidental expenses, except the cost of <br /> the work to be performed by the City of Everett as set forth in <br /> 27 Section 1, shall be borne by and assessed against the property <br /> included in the assessment district herein created in accord- <br /> 28 ance with the special benefits derived from the improvement accord- <br /> ing to the zone and termini method of spreading assessments . <br /> 29 The City shall not be liable in any manner for any of the <br /> remaining costs and expenses of the improvement, except as <br /> 30 provided by Chapter 141, Session Laws of 1923 or acts amendatory <br /> thereto and the Ordinances of the City of Everett . <br /> 31 Section 3: That there is hereby established a local <br /> 32 improvement district to be known as Local Improvement District <br />
