1 ORDINANCE NO. 3834 2 AN ORDINANCE providing for the improvement of: 3 BROADWAY from 1Oth Street to Tower Street TOWER STREET from Broadway to Waverly Avenue 4 WAVERLY AVENUE from Tower Street to north line of Radio Addition 5 by the construction of a 12" water main with hydrant and necessary 6 appurtenances, all in accordance with Resolution No. 6336 of the City of Everett, creating a local improvement district; creating 7 a local improvement district fund therefore; and providing for the payment of a part of said improvement by special assessments 8 on the property and in said district under the mode of payment by bonds . The property in the assessment district will be charged 9 with the cost of a 6" water main and hydrant including engineering cost and fixed estimate and in addition lots on Broadway serviced 10 by a 2" water main will be credited with the cost of a 2" water main, the difference between the cost of a 12" water main and 11 hydrant and the cost charged to the Assessment District shall be borne by the City of Everettdater Department . 12 WHEREAS, by Resolution No. 6336 of the City of Everett, 13 the City Council has declared its intention to order the improve- ment as above outlined and doing all work in connection therewith 14 to make a complete improvement in accordance with the plans and specifications of the City Engineer of the City of Everett . 15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 16 Section 1: That an improvement be made of BROADWAY 17 from 1Oth Street to Tower Street; TOWER STREET from Broadway to Waverly Avenue; WAVERLY AVENUE from Tower Street to north line 18 of Radio Addition by the construction of a 12" water main with hydrant and necessary appurtenances, all in accordance with plans 19 to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. The property in the Assessment 20 District will be charged with the cost of a 6" water main and hydrant including engineering costs and fixed estimate and in 21 addition lots on Broadway serviced by a 2" water main will be credited with the cost of a 2" water main. The difference between 22 the cost of a 12" water main and hydrant and the cost charged to the Assessment District shall be borne by the City of Everett 23 Water Department . 24 Section 2: That the cost and expense of such improve- ment, including all necessary incidental expenses, except such 25 costs as shall be paid by the City of Everett as above provided, shall be borne by and assessed against the property included in 26 the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini 27 method of spreading assessments . The City of Everett shall not be liable in any manner for any portion of the costs and expenses 28 of such improvement as above provided, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, 29 and the ordinances of the City of Everett, and except such costs as this ordinance shall specifically provide to be paid by the 30 City of Everett . 31 Section 3: That there is hereby established a Local Improvement District No. 662, which district shall include the 32 following described property located in Everett, Snohomish County, Washington, to-wit:
