any installed electronic security system and coordinate pass codes, keys and <br /> security measures with the City. <br /> 7. Improvements <br /> a. Any improvements, additions, alterations or changes(collectively, <br /> "improvements")to the courses made by the Contractor shall be subject to,prior <br /> to the commencement of the improvements work,written approval by the City <br /> and the securing of applicable permits, and compliance with such terms and <br /> conditions as may be imposed by the City such as the payment of prevailing <br /> wages. <br /> 8. City Ownership <br /> a. Ownership of all courses' structures, buildings or improvements thereto or <br /> thereon,merchandise, golf carts, hand carts and course maintenance equipment <br /> constructed or acquired by the City, or Contractor on behalf of the City, and all <br /> alterations, additions or betterments thereto, shall remain with and owned by <br /> the City. <br /> 9. Failure to Perform <br /> a. Should the Contractor fail,after thirty (30)days written notice from the City <br /> of the need therefore,to perform its obligations under this Article C,the City <br /> may enter upon the Premises of the course and perform Contractor's <br /> obligations. Notwithstanding the preceding sentence, in the event of an <br /> emergency,the City may immediately enter upon the Premises without notice <br /> to the Contractor to perform emergency repairs and restoration. <br /> 10. Accountability <br /> a. Establish, maintain and submit accurate reports and records regarding the <br /> following items: <br /> 1) All revenue (monthly). <br /> 2) Tournaments, leagues, clubs and special events booking (monthly or <br /> as needed). <br /> 3) Player development programs, lessons and clinics (annually). <br /> 4) Course utilization to include rounds of golf by fee category, <br /> promotional packaging,playable days, rounds inventory, reservations <br /> by medium, cancellations, etc. (monthly). <br /> 5) Car usage and maintenance (annually). <br /> 6) Daily weather(as needed). <br /> 7) Starting times(as needed). <br /> 8) Customer data base by fee and type of play (as needed). <br /> 9) Customer memberships(as needed). <br /> 10) Other reports and records that may be required by the City of <br /> Everett(as needed). <br /> b. The City has sole authority regarding the type and frequency of reports and <br /> records that must be submitted. <br /> 7 <br />
