a. The Contractor shall submit to Parks, for its review and approval, on or before <br /> July 15 of each operating year, a Budget Recommendation for the next year. <br /> Each Budget Recommendation shall include, but not be limited to the following <br /> for the next operating year: <br /> 1) Estimated gross revenue by profit center. <br /> 2) Estimated direct costs by profit center. <br /> 3) Estimated Rounds of golf by golfer type and group. <br /> 4) Estimated financial statements. <br /> 5) Analysis of previous years actual revenue and expenses compared <br /> to budget. <br /> 6) Recommendations on changes to rates by profit center and golfer <br /> type. <br /> 7) Competitive analysis and positioning. <br /> 8) Marketing Strategies and Promotional Plan (Optional) <br /> 3. Leases <br /> a. The Contractor shall provide to Parks copies of any and all current leases <br /> entered into by the Contractor and any vendor,contractor or subcontractor for <br /> services or goods provided to the Contractor at the courses. <br /> 4. Compliance with Laws <br /> a. The Contractor and Parks shall comply with all municipal ordinances and all <br /> state and federal laws and regulations applicable to the terms and conditions of <br /> this Contract. The Contractor and Parks shall not knowingly permit any illegal <br /> activities to be conducted on or at the premises of the courses. <br /> b. If any permits or licenses are required,the Contractor shall obtain all such <br /> required permits or licenses from the appropriate regulatory agency before <br /> undertaking the regulated activity. The non-labor direct cost of obtaining such <br /> licenses and permits will be considered "Direct Costs." <br /> 5. Discrimination <br /> a. The Contractor agrees to comply with all state and local laws prohibiting <br /> discrimination with regard to creed, religion, race, age, color, sex, marital status, <br /> sexual orientation, gender identity,political ideology, ancestry, national origin, <br /> or the presence of any sensory, mental or physical disability unless based upon a <br /> bona fide occupational qualification. <br /> 6. Signs <br /> a. The Contractor shall not post any signs,other than normal day-to-day operating <br /> prices,promotions and activity signs, at the courses without the prior approval <br /> of the Director. <br /> 7.
