City of Everett Hold Harmless Agreement <br />July 8, 2019 <br />Tony Lee <br />Building Official <br />City of Everett Public Works <br />3200 Cedar Street <br />Everett, WA 98201 <br />Dear Mr. Lee: <br />This letter is intended to formally request that Compass Health Broadway PSH LLLP <br />Owner be allowed to submit a building permit application for the Compass Health <br />Broadway Permanent Supportive Housing project prior to approval by the Planning <br />Department of the SEPA/Land Use Application submitted on March 26, 2019. <br />-We acknowledge to the City, that Compass Health Broadway PSH LLLP understands the <br />risks associated with submitting the building permit application prior to approval of the <br />(SEPA)/Land Use Application and further understands that submitting for a building permit <br />does not vest the project or imply that land use approvals will be given. <br />Finally, Compass Health Broadway PSH LLLP agrees to hold the City of Everett harmless <br />for the loss of paid application fees, design fees, and other fees that may be incurred if the <br />SEPA/Land Use comments cause the project to be altogether denied, affects the timeframe <br />that creates a feasibility issue related to the project or requires additional design <br />modifications subsequent to submittal of the building permit. <br />Compass Health Broadway PSH LLLP <br />By: Compass Health <br />Its: General Partner <br />00 <br />By: <br />(Tom Sebastian) <br />Title: President / CEO <br />Acceptance of Hold Harmless (to be signed by City) Date <br />L�2 )) <br />
