We recently <br />received new direction from management regarding geo covenants/agreements and when they are to be recorded. <br />Based on this new direction, your project would not require a covenant/agreement to be recorded since it is not located <br />within a required buffer or altering the geologically hazardous area directly. Forfuture reference and projects, please <br />note this change in direction applies to the geo covenant/declaration only —nothing else has changed regarding when <br />critical area reports, including geo assessments/reports, are required. <br />The file has been routed to the Permit Technicians for processing. They will be in touch when it is ready for pick-up and <br />any remaining fees required. I have reviewed the report and the proposed plan <br />and both look good for Planning however before I can formally sign off on the permit for issuance, a geo covenant and <br />agreement must be completed and recorded with the County Auditor in accordance with EMC 19.37.080.D.1.b. <br />Attached, I have included the geological hazardous area covenant (the Declaration starts on page 1 and the Agreement <br />starts on page 8). The documents need to be signed and notarized by the property owner (refer to pages 4 and 11 for <br />the "single person" signature pages) and the lender if applicable. Please stay outside of the one inch margins in the <br />document or the County Auditor will charge extra for your recording. Note: the geologically hazardous declaration and <br />agreement require signature by the Mayor's office. Please submit the signed and notarized forms to me at your earliest <br />convenience so 1 can route them accordingly for signature. Notaries are available at our Permit Services counter if that <br />proves a move convenient option for the owner. <br />
