S <br /> FINDINGS OF FACT <br /> 1. Jeremy D. and Nicholas B.Jones (Respondents)are the owners of property 2306 Rainier <br /> Avenue,Everett,Washington(subject property),which is in an R-2, Single-Family Medium <br /> Density Residential zone. A single-family residential structure is located on the subject <br /> property,which according to the Snohomish County Assessor's record is a four family <br /> residence. (Exhibit#10, Snohomish County Assessor's record, dated March 21, 2018) <br /> (Exhibit#11, Go Sync Map) <br /> 2. On January 5,2018,the Respondents applied for an electrical permit(#E1801-037)to <br /> upgrade electrical service and circuits to install a washer in a single-family residential <br /> structure. (Exhibit#6, City of Everett Electrical Permit#E1801-037, dated January 5, <br /> 2018) (Testimony of Code Enforcement Officer Cunningham) <br /> 3. On January 25,2018,while conducting an inspection of the electrical system in the <br /> residential structure located on the subject property, City of Everett Electrical Inspector <br /> Steve Banks observed that the single-family structure had been converted into four separate <br /> apartment units. Inspector Banks was concerned about having all four of the apartments <br /> being serviced by one electrical system and meter. Upon review of City records, City of <br /> Everett Chief Inspector Ted de Budden determined that required City permits had not been <br /> obtained for the conversion and referred the matter to the City of Everett Code Enforcement <br /> unit for enforcement action. In response to a complaint from the City of Everett Building Division, City of Everett Code <br /> Enforcement Officer Don Cunningham conducted an inspection of the residential structure <br /> on the subject property on January 29,2018. While on site,Officer Cunningham observed <br /> and photographed that four mail boxes had been mounted on a post of the front porch of the <br /> single-family residential structure located on the subject property. He further observed that <br /> a rear entry into the residence had been labeled"APT 4". Upon review of the permit history <br /> of the subject property, Officer Cunningham discovered that in 1909 a permit was issued to <br /> connect to city water and the premises was listed as a residence; in 1953 a permit was issued <br /> to install a new bathroom in the basement; in 1961 a permit was issued to install an entrance <br /> way to the basement; and in 1998 a permit was issued to change a gas water heater in a <br /> single-family residence. On February 9,2018, Officer Cunningham and Chief Tnspector de Budden met the Property <br /> Manager on the subject property to conduct an interior inspection of the residential structure. <br /> During the inspection Officer Cunningham observed and photographed the following <br /> conditions: <br /> a. The single-family residence had been converted into five separate apartments each with •• <br /> their own kitchen,bathroom and bedroom(s). There were two upper apartments,two <br /> basement apartments,and one apartment on the main level of the structure. All five <br /> units had been rented to unrelated,individual tenants. <br /> 2 <br />
